Requests the Senate Committee on Senate and Governmental Affairs and the House Committee on House and Governmental Affairs to jointly study the appropriate use of campaign funds. A CONCURRENT RESOLUTI ON1 To urge and request the Senate Committee on Senate and Governmental Affairs and the2 House Committee on House and Governmental Affairs to meet and function as a3 joint committee to study and make recommendations with respect to the appropriate4 use of campaign funds.5 WHEREAS, the Campaign Finance Disclosure Act (CFDA) requires contributions6 received by an elected official be expended for any lawful purpose; and7 WHEREAS, the CFDA prohibits an elected official from using his campaign funds8 for expenditures that are not related to the holding of public office; and9 WHEREAS, the CFDA prohibits the use of campaign funds for any personal use10 unrelated to the candidate's campaign or his holding of public office; and11 WHEREAS, the CFDA provides that excess funds may be used for a future12 campaign; returned to contributors on a pro rata basis; given as charitable contributions; or13 in support of or in opposition to a proposition, political party, or candidate; and14 WHEREAS, in years past, the Board of Ethics has issued numerous opinions15 regarding the proper use or misuse of an elected official's campaign funds; and16 WHEREAS, it is the legislature's intention to ensure the accurate and consistent17 application of the CFDA. 18 SCR NO. 78 SLS 13RS-405 ORIGINAL Page 2 of 2 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby requests1 the members of the Senate Committee on Senate and Governmental Affairs and the House2 Committee on House and Governmental Affairs to meet and function as a joint committee3 to study and make recommendations with respect to the appropriate use of campaign funds.4 BE IT FURTHER RESOLVED that the joint legislative committee shall submit5 recommendations to the Legislature of Louisiana not later than February 1, 2014.6 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Tim Prather.
