Directs the commissioner of administration to ensure that the name and contact information of each custodian of public records of an agency be included on the website of the agency. A RESOLUTION1 To authorize and direct the commissioner of administration to take all necessary action to2 ensure that each department, office, agency, board, and commission of the executive3 branch of state government which maintains a website on the Internet include the4 name and contact information for each custodian of public records for that entity on5 the website.6 WHEREAS, Section 3 of Article XII of the Constitution of Louisiana guarantees that7 no person shall be denied the right to examine public documents, except in cases established8 by law; and9 WHEREAS, it is the essence of the Public Records Law that all public records in the10 custody of a public entity can be viewed and copied by any citizen; and 11 WHEREAS, the Public Records Law declares that providing access to public records12 is a responsibility and duty of the appointive or elective office of a custodian and his13 employees; and14 WHEREAS, the Public Records Law defines "custodian" as "the public official or15 head of any public body having custody or control of a public record, or a representative16 specifically authorized by him to respond to requests to inspect any such public records";17 and18 SR NO. 159 SLS 13RS-3203 ORIGINAL Page 2 of 2 WHEREAS, while the Public Records Law requires that a custodian present any1 public record to any person of the age of majority who so requests, it is often not apparent2 who is the "custodian" to whom to make the request; and3 WHEREAS, nearly all agencies of the executive branch of state government maintain4 a website on the Internet.5 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana6 does hereby authorize and direct the commissioner of administration to take all necessary7 action to ensure that each department, office, agency, board, and commission of the8 executive branch of state government which maintains a website on the Internet include the9 name and contact information for each custodian of public records for that entity on the10 website.11 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the12 commissioner of administration.13 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Jerry J.
