SENATE RESOLUTION NO. 195

SENATE. Urges and requests Senate Committee on Judiciary A to study laws applicable
to the rights of landlords and tenants.
A RESOLUTION1
To urge and request the Senate Committee on Judiciary A to study the laws applicable to the2
rights of landlords and tenants.3
WHEREAS, the state of Louisiana and its municipalities ensure people have safe and4
affordable housing as one of the basic necessities needed for a healthy community; and5
WHEREAS, over the years legislation has been considered to prohibit predatory6
renting in the residential housing market; and7
WHEREAS, renters who run into conflicts with landlords have few rights to invoke,8
and often face an eviction process at a fast rate of speed; and9
WHEREAS, the entire eviction process can take as little as two weeks, from the time10
landlords notify their tenants of their intention to evict to the final court ruling ordering the11
inhabitants of the property to vacate; and12
WHEREAS, the threat of eviction, and the speed at which people can be evicted, is13
enough to keep most tenants in line and prevent them from complaining about poor14
conditions; and15
WHEREAS, laws such as the Uniform Residential Landlord and Tenant Act16
(URLTA) should be studied to determine whether the state should adopt such Act to define17
the many rights and obligations of tenants and private landlords.18 SR NO. 195

THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana1
does hereby urge and request the Senate Committee on Judiciary A to study the laws2
applicable to the rights of landlords and tenants.3
BE IT FURTHER RESOLVED that the committee submit a written report of its4
findings, together with any proposed legislation, to the Senate not later than February 1,5
2014.6
