BY REPRESENTATIVE ANDERS
MTR VEHICLE/DRIVER LIC: Exempts drivers who possess valid military licenses from
the knowledge and skills test requirements to obtain a Class "A", "B", and "C"
commercial driver's license
AN ACT1
To enact R.S. 32:408(A)(5), relative to commercial driver's licenses; to exempt drivers with2
military licenses from certain test requirements for Class "A", "B", and "C" driver's3
licenses; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 32:408(A)(5) is hereby enacted to read as follows:6

(5) Notwithstanding any other provision to the contrary, the skills test10
required for Classes "A", "B", and "C" commercial driver's licenses shall be waived11
for an applicant who meets one of the following requirements:12
(a) Certifies that, during the two-year period immediately prior to applying13
for a commercial driver's license, he has not had any of the following:14
(i)  More than one license, except for a military license.15
(ii)  Any license suspended, revoked, or cancelled.16
(iii) Any convictions for any type of motor vehicle for the disqualifying17
offenses contained in Federal Motor Carrier Safety Administration Regulations.18 HLS 14RS-266	ENGROSSED

(iv) More than one conviction for any type of motor vehicle for serious1
traffic violations contained in Federal Motor Carrier Safety Administration2
Regulations.3
(v)  Any conviction for a violation of military, state, or local law relating to4
motor vehicle traffic control, other than a parking violation, arising in connection5
with any traffic accident, and has no record of an accident in which he or she was at6
fault.7
(b)  Provides evidence and certifies that he:8
(i) Is or was regularly employed within the last ninety days in a military9
position requiring operation of a CMV.10
(ii) Was exempted from the CDL requirements in Federal Motor Carrier11
Safety Administration Regulations.12
(iii) Was operating a vehicle representative of the CMV the driver applicant13
operates or expects to operate, for at least the two years immediately preceding14
discharge from the military.15

Abstract: Provides an exemption to the skills testing requirements for Class "A", "B", and
"C" commercial driver's licenses.
Present law requires that applicants for Classes "A", "B", and "C" commercial driver's
licenses must correctly answer at least 80% of the questions on each knowledge test and
successfully perform all of the required skills on the skills test to achieve passing scores.
Proposed law provides that the skills test requirements applicable to Class "A", "B", and "C"
commercial driver's licenses are waived if a driver meets one of the following requirements:
(1)Certifies that, during the two-year period immediately prior to applying for a
commercial driver's license, he has not had any of the following:
(a)More than one license, except for a military license.

(c)Any convictions for any type of motor vehicle for the disqualifying offenses
contained in Federal Motor Carrier Safety Administration Regulations.
(d)More than one conviction for any type of motor vehicle for serious traffic
violations contained in Federal Motor Carrier Safety Administration
Regulations.
(e)Any conviction for a violation of military, state, or local law relating to
motor vehicle traffic control, other than a parking violation, arising in
connection with any traffic accident, and has no record of an accident in
which he or she was at fault.
(2)Provides evidence and certifies that he:
(a)Is or was regularly employed within the last 90 days in a military position
requiring operation of a CMV.
(b)Was exempted from the CDL requirements in Federal Motor Carrier Safety
Administration Regulations.
(c)Was operating a vehicle representative of the CMV the driver applicant
operates or expects to operate, for at least the two years immediately
preceding discharge from the military.
