CRIME:  Amends criminal penalties for violations of the statute regarding Peeping Toms
AN ACT1
To amend and reenact R.S. 14:284, relative to offenses affecting public morals; to amend2
the criminal penalty provisions in the statute regarding Peeping Toms; and to provide3
for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 14:284 is hereby amended and reenacted to read as follows: 6
ยง284.  Peeping Tom; penalty penalties 7
A. No person shall perform such acts as will make him a "Peeping Tom" on8
or about the premises of another, or go upon the premises of another for the purpose9
of becoming a "Peeping Tom". 10
B. "Peeping Tom" as used in this Section means one who peeps through11
windows or doors, or other like places, situated on or about the premises of another12
for the purpose of spying upon or invading the privacy of persons spied upon without13
the consent of the persons spied upon.  It is not a necessary element of this offense14
that the "Peeping Tom" be upon the premises of the person being spied upon.15
C.(1) Whoever violates this Section, upon a first conviction, shall be fined16
not more than five hundred dollars, or imprisoned for not more than six months, or17
both.  18
(2) Upon a second conviction, the offender shall be fined not more than19
seven hundred fifty dollars, imprisoned for not more than six months, or both.20 HLS 14RS-1648	ORIGINAL

(3) Upon a third or subsequent conviction, the offender shall be fined not1
more than one thousand dollars, imprisoned with or without hard labor for not more2
than one year, or both.3

Abstract: Adds criminal penalties for second and subsequent convictions for a violation of
the provisions of the statute regarding Peeping Toms.
Present law provides that no person shall perform such acts as will make him a "Peeping
Tom" on or about the premises of another, or go upon the premises of another for the
purpose of becoming a "Peeping Tom".
Present law provides that "Peeping Tom" means one who peeps through windows or doors,
or other like places, situated on or about the premises of another for the purpose of spying
upon or invading the privacy of persons spied upon without the consent of the persons spied
upon, regardless of whether the "Peeping Tom" is upon the premises of the person being
spied upon.
Present law provides that whoever violates these provisions of present law shall be fined not
more than $500, imprisoned for not more than six months, or both.  
Proposed law retains present law and provides as follows for violations of the provisions of
present law:
(1)For a second conviction - A fine of not more than $750, imprisonment for not more
than six months, or both.
(2)For a third or subsequent conviction - A fine of not more than $1,000, imprisonment
for not more than one year, or both.
