Regular Session, 2014 HOUSE BILL NO. 106 BY REPRESENTATIVE LOPINTO TRANSPORTATION: Provides relative to the improper display of license plates AN ACT1 To amend and reenact R.S. 32:53(A) and to repeal R.S. 47:507, relative to motor vehicle2 license plates; to provide for the proper display of license plates; and to provide for3 related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:53(A) is hereby amended and reenacted to read as follows:6 ยง53. Proper equipment required on vehicles; display of plate7 A.(1) No person shall drive or move, nor cause or knowingly permit any8 vehicle owned or controlled by him to be driven or moved, on any highway of this9 state, at any time, any vehicle or combination of vehicles which is in such unsafe10 condition as to endanger any person or property, or which does not contain those11 parts or is not at all times equipped with such lamps and other equipment, in proper12 condition and adjustment, as required in this Chapter, or which is constructed or13 equipped in any manner in violation of this Chapter, and no person shall do any act14 forbidden or fail to perform any act required under this Chapter.15 (2) The permanent registration license plate assigned to a trailer, semitrailer,16 motorcycle, or other motor vehicle shall be attached to the rear thereof.17 Notwithstanding the foregoing, the permanent registration license plate assigned to18 any truck having a gross vehicle weight in excess of ten thousand pounds or to any19 dump truck may be attached to either the front or rear thereof. For the purposes of20 this Section, dump truck means any truck with a bed that raises to dump a load. (3) Every permanent registration license plate shall at all times be securely1 fastened to the vehicle to which it is assigned, so as to prevent the plate from2 swinging, and at a height not less than twelve inches from the ground, measuring3 from the bottom of such plate, in a place and upright position to be clearly visible,4 and shall be maintained free from foreign materials and in a condition to be clearly5 legible.6 * * *7 Section 2. Present law (R.S. 47:507) provides that motor vehicle permanent registration plates be securely fastened to the assigned motor vehicle in a manner to prevent the plate from swinging, and at a height not less than 12 inches from the ground from the bottom of such plate in a place and position to be clearly visible, and shall be maintained free from foreign materials and in a condition to be clearly legible. Also, specifies that any permanent registration license plate assigned to a truck weighing in excess of 6,000 pounds may be attached to the front or the rear of the vehicle. Proposed law modifies present law by specifying that a truck with a gross weight in excess of 10,000 pounds may attach a permanent registration license plate to the front or rear of the vehicle. Proposed law provides that all permanent registration plates be affixed to the motor vehicle in an upright position to be clearly visible. (Amends R.S. 32:53(A); Repeals R.S. 47:507) Summary of Amendments Adopted by House Committee Amendments Proposed by House Committee on Transportation, Highways and Public Works to the original bill. 1. Added a provision that provides that the permanent registration license plate assigned to any truck having a gross vehicle weight in excess of 10,000 pounds, as opposed to 6,000 pounds, or to any dump truck may be attached to either the front or the rear of the truck.
