Regular Session, 2014 HOUSE BILL NO. 1071 BY REPRESENTATIVE CHANEY HUNTING/LICENSES: Reduces the time required to qualify as a resident for hunting and fishing licenses AN ACT1 To amend and reenact R.S. 56:8(16), relative to resident status for purchase of hunting and2 fishing licenses; to reduce the time required to qualify as a resident for the purchase3 of hunting licenses; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 56:8(16) is hereby amended and reenacted to read as follows: 6 ยง8. Definitions7 For purposes of this Chapter, the following words and phrases have the8 meaning ascribed to them in this Section, unless the context clearly shows a different9 meaning:10 * * *11 (16)(a) Except as specified in Subparagraph (b) of this Paragraph, "Bona12 bona fide resident" means any person who is a United States citizen or resident alien13 and has resided in this state continuously during the twelve months immediately14 prior to the date on which he applies for any license and who has manifested his15 intent to remain in this state by establishing Louisiana as his legal domicile, as16 demonstrated by compliance with all of the following, as applicable:17 (i) If registered to vote, he is registered to vote in Louisiana.18 (ii) If licensed to drive a motor vehicle, he is in possession of a Louisiana19 driver's license, or, if over the age of fifteen years and not licensed to drive, he is in20 HLS 14RS-1855 REENGROSSED HB NO. 1071 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. possession of a special identification card issued by the Department of Public Safety1 and Corrections under the provisions of R.S. 40:1321.2 (iii) If owning a motor vehicle located within Louisiana, he is in possession3 of a Louisiana registration for that vehicle.4 (iv) If earning an income, he has filed a Louisiana state income tax return5 and has complied with state income tax laws and regulations.6 (b) For purchase of a license for hunting or recreational fishing activities7 where such license does not authorize any commercial activity, "bona fide resident"8 means any person who is a United States citizen or resident alien and has resided in9 this state continuously during the six months immediately prior to the date on which10 he applies for any such license and who has manifested his intent to remain in this11 state by establishing Louisiana as his legal domicile, as demonstrated by compliance12 with Items (a)(i) through (iv) of this Paragraph.13 (c) As to a corporation or other legal entity, a resident shall be any which is14 incorporated or otherwise organized under and subject to the laws of Louisiana, and15 which is domiciled in Louisiana and has a permanent physical location of business16 in Louisiana where records are held in compliance with R.S. 56:306.4.17 (c) (d) Any person, corporation, or other legal entity which possesses a18 resident license from any other state or country shall not qualify for a resident license19 in Louisiana.20 * * *21 DIGEST The digest printed below was prepared by House Legislative Services. Present law defines "bona fide resident" as a person who is a U. (1)If registered to vote, he is registered to vote in La. (2)If licensed to drive a motor vehicle, he possesses a La. driver's license. (3)If owning a motor vehicle located within La., the vehicle is registered in La. (4)If earning an income, he has filed a La. state income tax return. Proposed law, for purchase of a license for hunting or recreational fishing activities where such license does not authorize any commercial activity, reduces the time required to qualify as a bona fide resident from twelve months to six months. Present law provides that any person, corporation, or other legal entity which possesses a resident license from any other state or country shall not qualify for a resident license in La. Proposed law retains present law. (Amends R.S. 56:8(16))
