ENVIRONMENT/WASTE SITES: Prohibits landfill facilities used exclusively for the
disposal or storage of waste tire material
AN ACT1
To enact R.S. 30:2154(E), relative to solid waste facilities; to prohibit landfills used2
exclusively to dispose or store waste tire material; to provide for exceptions; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 30:2154(E) is hereby enacted to read as follows:6

E. Notwithstanding any other provision of the law to the contrary, the9
secretary shall not issue any permit or permit renewal or promulgate any rule or10
regulation which would allow the construction or operation of a landfill facility used11
exclusively for the disposal or storage of waste tire material. This Subsection shall12
not apply to waste tire material that is recycled or that reaches end-market uses in the13

Abstract: Prohibits landfills used exclusively to dispose or store waste tire material.
Present law requires the secretary of the Dept. of Environmental Quality to adopt by
regulation a system for the permitting of all solid waste disposal facilities. Proposed law
retains present law.
Proposed law prohibits the secretary from issuing any permit or permit renewal or
promulgate any rule or regulation which would allow the construction or operation of a
landfill facility used exclusively for the disposal or storage of waste tire material.
Proposed law provides that proposed law shall not apply to waste tire material that is
recycled or that reaches end-market uses in the construction of a landfill facility.
