Regular Session, 2014 HOUSE BILL NO. 1091 BY REPRESENTATIVES WILLMOTT AND BILLIOT ANIMALS: Prohibits the transportation of dogs in pickup truck beds on certain roadways unless humanely secured AN ACT1 To enact R.S. 32:284.1, relative to the transportation of dogs; to prohibit the transportation2 of dogs in pickup truck beds on certain roadways; to provide exceptions; to provide3 for penalties; to provide definitions; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:284.1 is hereby enacted to read as follows:6 ยง284.1. Transporting dogs in pickup truck beds on interstate highways; generally7 prohibited; exceptions8 A.(1) No person shall be permitted to transport a dog or dogs in a pickup9 truck bed on an interstate highway in this state.10 (2) The provisions of this Section shall not apply if the dog or dogs are11 transported in a secure, humane manner that prevents the dog or dogs from falling,12 jumping, or being thrown from the pickup truck bed.13 B.(1) Transporting one dog in violation of the provisions of this Section shall14 be punishable by a fine of not more than one hundred fifty dollars.15 (2) Transporting more than one dog at the same time in violation of this16 Section shall be punishable by the fine imposed by Paragraph (1) of this Subsection17 for any one of the dogs and a fifty-dollar fine for each additional dog.18 C. D. For the purposes of this Section, "humane manner" means the transport1 of a dog or dogs in one of the following ways:2 (1) Being physically inside of an enclosed container, crate, kennel, or cage,3 that is safely secured to the inside of the bed of a pickup truck that provides adequate4 ventilation for the dog or dogs to maintain oxygen intake and breathe without5 distress, and enough space for the dog or dogs to stand, sit, and turn around.6 (2) Being physically restrained by a restraint system that is long enough to7 allow the dog to move its head above its shoulders while standing and short enough8 to prevent the dog from falling, jumping, or being thrown from the bed of the pickup9 truck. For purposes of this Subsection, a "restraint system" means any apparatus10 used for the purpose of restricting a dog's movements, which may consist of a collar,11 harness, leash, lead, rope, tie out, or any other securing device, used independently12 or collectively that does not cause any harm to the dog or dogs.13 (3) Being physically enclosed in the bed of a pickup truck that is covered by14 a ventilated top that prevents the dog or dogs from jumping, falling, or being thrown15 from the bed of the pickup truck. Proposed law prohibits drivers from transporting dogs in the back of pickup trucks on interstate highways within this state. Proposed law defines "humane manner" and provides for exceptions relative to dogs that are secured in a humane manner in one of the following ways: (1)Physically inside of an enclosed container, crate, kennel, or cage, that is safely secured to the inside of the bed of a pickup truck that provides adequate ventilation for the dog or dogs to maintain oxygen intake and breathe without distress, and enough space for the dog or dogs to stand, sit, and turn around. (2)Physically restrained by a restraint system that is long enough to allow the dog to move its head above its shoulders while standing and short enough to prevent the dog from falling, jumping, or being thrown from the bed of the pickup truck. (3)Physically enclosed in the bed of a pickup truck that is covered by a ventilated top that prevents the dog or dogs from jumping, falling, or being thrown from the bed of the pickup truck. Proposed law defines "restraint system" as any apparatus used for the purpose of restricting a dog's movements, which may consist of a collar, harness, leash, lead, rope, tie out, or any other securing device, used independently or collectively that does not cause any harm to the dog or dogs. Proposed law provides that the penalty for transporting one dog in violation of proposed law is a fine of not more than $150. Proposed law provides that an additional fine of $50 per dog shall be imposed for each additional dog transported at the same time in violation of proposed law.
