Abstract: Prohibits use of public funds for an advertisement containing the name or picture of a
public official within one year prior to a regularly scheduled election for an office for
which the public official is a candidate.
Present law (R.S. 43:111.1) provides that no public funds shall be used in whole or in part for the
payment of the cost of any advertisement containing therein the name of any public official
whether elected or appointed.
Proposed law retains present law and adds an advertisement containing the picture of a public
official to the prohibition.
Present law provides that it shall not be construed to apply to advertisements or notices required
or authorized by law to be published or to advertisements placed by a public agency or body
authorized by law to advertise in the furtherance of its functions and duties.

Proposed law additionally provides that no public funds shall be used in whole or in part for the
payment of the cost of any advertisement containing therein the name or picture of any public
official, whether elected or appointed, within one year prior to a regularly scheduled election for
an office for which the public official is a candidate.  Provides that the term "candidate" means a
person who seeks nomination or election to public office.  Provides an exception for an
advertisement relating to the health, safety, or welfare of La. residents.
