MTR VEHICLE/DRIVER LIC: Provides for the suspension of a person's driver's license
for failure to pay fine or failure to appear in court when charged with littering
AN ACT1
To amend and reenact R.S. 30:2531.5(C), relative to penalties for littering; to provide for the2
suspension of a person's driver's license for failing to pay fine or appear in court; and3
to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 30:2531.5(C) is hereby amended and reenacted to read as follows:6
ยง2531.5.  Legal enforcement; penalties; payment by mail or credit card7

C. Each  governing authority on whose behalf citations are issued for alleged9
violations of the provisions of R.S. 30:2531 through 2531.3 shall establish a10
procedure by which alleged offenders may plead guilty to the alleged offense and11
pay the fine by mail; however, if the offender fails to pay the fine by mail in advance12
of adjudication and fails to appear at the time and date indicated on the citation, the13
court may impose an additional fine or penalty in an amount not to exceed the14
amount of the fine or penalty for the original violation.  Further, the court may15
suspend the driver's license of the offender until such fines are paid. In addition,16
each governing authority shall establish a procedure allowing for payment of the fine17
by credit cards credit card as it may designate. However, the procedure shall not18
limit such payments to payment by credit card.19

Abstract: Requires courts to suspend the driver's license of a person charged with littering
who fails to pay the fine by mail in advance of adjudication and fails to appear at his
scheduled court date.
Present law provides that each governing authority on whose behalf citations are issued for
alleged littering violations shall establish a procedure by which alleged offenders may plead
guilty to the offense and pay the fine by mail.  Present law also provides that if the offender
fails to pay the fine by mail in advance of adjudication and fails to appear in court, the court
may impose an additional fine or penalty in an amount not to exceed the original fine or
penalty for the original violation.
Proposed law adds to present law by authorizing courts to suspend the driver's license of the
alleged offender who fails to pay by mail in advance and fails to appear in court. The
driver's license shall remain suspended until the fines are paid.
