Regular Session, 2014 HOUSE BILL NO. 1125 BY REPRESENTATIVE BURFORD ENVIRONMENT: Provides for the closure of oxidation ponds AN ACT1 To enact R.S. 30:2074(B)(3)(g), relative to oxidation ponds; to provide the closure of certain2 oxidation ponds; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 30:2074(B)(3)(g) is hereby enacted to read as follows:5 ยง2074. Water quality control; secretary of environmental quality; powers and duties6 * * *7 B. The secretary shall have the following powers and duties:8 * * *9 (3) To adopt and promulgate rules and regulations consistent with the10 general intent and purposes of this Chapter to prevent water pollution, including but11 not limited to the following:12 * * *13 (g) Regulations providing for the closure of oxidation ponds, lagoons, or14 surface impoundments. Present law requires the secretary of the Department of Environmental Quality to adopt and promulgate rules and regulations to prevent water pollution. Proposed law retains present law. Proposed law requires the adoption and promulgation of regulations providing for the closure of oxidation ponds, lagoons, or surface impoundments. Proposed law provides that for political subdivisions located in a parish having a population of not less than 25,800 and not more than 27,800, such regulations shall have the option to close oxidation ponds, lagoons, or surface impoundments in place by allowing the treatment of sewage sludge on site and allowing the treated sewage sludge to remain on site under cover.
