Regular Session, 2014 HOUSE BILL NO. 1136 BY REPRESENTATIVE JIM MORRIS ALCOHOLIC BEVERAGES: Authorizes acceptance of an out-of-state identification card for purposes of selling or serving alcoholic beverages AN ACT1 To enact R.S. 26:90(A)(1)(a)(vi) and 286(A)(1)(a)(vi), relative to selling or serving2 alcoholic beverages; to authorize the use of certain identification cards from another3 state as acceptable identification for being sold or served alcoholic beverages; and4 to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 26:90(A)(1)(a)(vi) and 286(A)(1)(a)(vi) are hereby enacted to read7 as follows: 8 §90. Acts prohibited on licensed premises; suspension or revocation of permits9 A. Acts prohibited on licensed premises; suspension or revocation of permits1 A. No person holding a retail dealer's permit and no servant, agent, or2 employee of the permittee shall do any of the following acts upon the licensed3 premises:4 (1)(a) Sell or serve beverages of low-alcoholic content to any person under5 the age of twenty-one years, unless such person submits any one of the following:6 * * *7 (vi) A valid, current, special identification card of another state which8 contains a photograph of the person and birth date of the person submitting the9 identification card.10 * * *11 DIGEST The digest printed below was prepared by House Legislative Services. Present law prohibits a person holding a retail dealer's permit or the agent, associate, employee, representative, or servant of any such person to sell or serve alcoholic beverages to any person under the age of 21 years, on or about the licensed premises unless such person submits any one of the following: (1)A valid, current, Louisiana driver's license which contains a photograph of the person presenting the driver's license. (2)A valid, current, driver's license of another state which contains a photograph of the person and birth date of the person submitting the driver's license. (3)A valid, current, special identification card issued by La. pursuant to present law (R.S. 40:1321) containing a photograph of the person submitting the identification card. (4)A valid, current, passport or visa issued by the federal government or another country or nation, that contains a photograph of the person and the date of birth of the person submitting the passport or visa. (5)A valid, current, military or federal identification card issued by the federal government containing a photograph of the person and date of birth of the person submitting the identification card. Proposed law retains present law and adds a valid, current, special identification card issued by another state as acceptable proof of identification and age.
