Regular Session, 2014 HOUSE BILL NO. 1139 BY REPRESENTATIVE BURRELL MTR VEHICLE/OFFICE: Provides for a reduced convenience fee for mobility impaired persons at public license tag agents AN ACT1 To amend and reenact R.S. 47:532.1(C), relative to public license tax agents; to provide a2 reduced convenience fee for mobility impaired persons at public license tag agents;3 to provide for the definition of mobility impaired; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 47:532.1(C) is hereby amended and reenacted to read as follows:6 ยง532.1. Public license tag agents; auto title companies; rules and regulations; surety7 bonds; fees8 * * *9 C.(1) Public license tag agents shall be authorized to collect a convenience10 fee in addition to the registration license tax. The convenience fee shall not exceed11 eighteen dollars per license. However, the public license tag agents shall collect and12 retain the full amount of the convenience fee. The seller is authorized to charge the13 convenience fee authorized by this Subsection in connection with any retail sale, in14 addition to the fees authorized in Chapter 10-B of Title 6 of the Louisiana Revised15 Statutes of 1950.16 (2) The convenience fee for those persons who are mobility impaired shall17 not exceed nine dollars per license. (a) Unable to walk two hundred feet without stopping to rest.1 (b) Unable to walk without the assistance of another person, walker, cane,2 crutches, braces, prosthetic device, or wheelchair, including individuals who are3 blind or have such a visual impairment that the assistance of another person is4 necessary to walk.5 (c) Restricted by a lung disease to such an extent that the person's forced6 expiratory volume for one second is less than one liter, or the arterial oxygen tension7 is less than sixty mm/hg on room air at rest.8 (d) Uses portable oxygen.9 (e) A cardiac condition to the extent that the person's functional limitations10 are classified in severity as Class III or Class IV according to standards set by the11 American Heart Association.12 (f) A diagnosed disease or disorder, including a severe arthritic, neurological,13 or orthopedic impairment, which creates a severe mobility limitation.14 * * *15 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law provides that the convenience fee charged by public license tag agents shall not exceed $9 for those persons who are mobility impaired. Proposed law defines "mobility impaired person" as a person impaired by any of the following conditions: (1)Unable to walk 200 feet without stopping to rest. (2)Unable to walk without the assistance of another person, walker, cane, crutches, braces, prosthetic device, or wheelchair, including individuals who are blind or so visually impaired that the assistance of another person is necessary to walk. (3)Restricted by a lung disease to such an extent that the person's forced expiratory volume for one second is less than one liter, or the arterial oxygen tension is less than 60 mm/hg on room air at rest.
