GERMAIN, THOMPSON, WHITNEY, AND WILLMOTT MOTOR VEHICLES: Provides relative to military honor license plates for service during the Cold War AN ACT1 To enact R.S. 47:490.26, relative to military honor license plates; to provide for the2 establishment of a military honor license plate for military service during the Cold3 War; to require the secretary to promulgate rules and regulations relative to the4 creation and implementation of this military honor license plate; to provide for the5 creation, issuance, and design of such plates; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 47:490.26 is hereby enacted to read as follows:8 ยง490.26. Military honor license plates; "Cold War Veteran"9 A. The secretary of the Department of Public Safety and Corrections shall10 establish a military honor license plate to be known as the "Cold War Veteran" plate.11 B. Upon application of a person showing reasonable proof of honorable12 service in the Armed Forces of the United States for no less than two years of active13 duty during the period September 2, 1945, to December 26, 1991, the secretary of14 the Department of Public Safety and Corrections shall issue a military honor license15 plate to be used in lieu of a regular motor vehicle registration plate. The military honor license plate shall be known as the "Cold2 War Veteran" license plate and shall bear a likeness of the Cold War Victory Medal,3 centered on the left side of the license plate and the words "COLD WAR4 VETERAN" centered on the bottom of the plate. The colors of the plate shall be red,5 white, and blue. 6 C. The fee for the license plate shall be the standard motor vehicle7 registration license fee provided for in R.S. 47:463. In addition to the standard fee8 imposed by Article VII, Section 5 of the constitution, in accordance with9 47:463(3)(b), a handling fee of three dollars and fifty cents for each plate shall be10 assessed and retained by the department to offset a portion of the administrative11 costs.12 D. The secretary shall adopt rules and regulations to implement the13 provisions of this Section, including but not limited to rules governing the transfer14 of license plates from one vehicle to another and the disposition of such license15 plates.16 E.(1) Any applicant who qualifies for the military honor license plate17 authorized by this Section may be issued a plate for each vehicle registered in the18 applicant's name.19 (2) Except as otherwise provided in this Paragraph, each military honor20 license plate issued pursuant to this Section shall be returned to the secretary upon21 the death of the person to whom the plate was issued. A surviving spouse of a22 person to whom a license plate was issued pursuant to this Section may retain a23 license plate issued pursuant to this Section, provided the surviving spouse has not24 remarried and provided the surviving spouse applies to the secretary for a transfer25 of the license plate to the surviving spouse.
