Regular Session, 2014 HOUSE BILL NO. 1162 BY REPRESENTATIVE KATRINA JACKSON PILOTS: Provides relative to pilotage fees and rates AN ACT1 To amend and reenact R.S. 34:1122(B)(1), relative to the Pilotage Fee Commission; to2 provide for pilotage fees and rates; to provide for an effective date; and to provide3 for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 34:1122(B)(1) is hereby amended and reenacted to read as follows:6 ยง1122. Fees and charges; adjudication of disputes7 * * *8 B.(1) Pilotage fees and rates shall may provide for all ordinary and necessary9 operating and administrative costs and expenses, including but not limited to the cost10 of, replacement of, and reasonable return on investment of pilot stations,11 administrative offices, furniture and fixtures, communication equipment and12 facilities, vessels, launches and other required vehicles of transportation and the13 expenses of maintaining and repairing same, other transportation expenses, the14 expense of maintaining necessary employees, operating materials, consumables and15 services, pensions, pension plans, hospitalization, disability compensation, taxes and16 licenses, life insurance, license insurance, trade promotions when requested to17 participate by industry or any port, required continuing education, legal expense,18 accounting expense, professional dues, administrative and professional publications,19 state pilot commissions, state and federal requirements, and fair average annual20 HLS 14RS-2532 ORIGINAL HB NO. 1162 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. compensation for a state ship pilot, in comparison to regulated state ship pilotage in1 other United States ports.2 * * *3 Section 2. This Act shall become effective upon signature by the governor or, if not4 signed by the governor, upon expiration of the time for bills to become law without signature5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law creates the Pilotage Fee Commission and provides that the commission shall have exclusive authority to fix and establish reasonable and just fees and rates for all of the following: (1)Pilotage service to ships and vessels. (2)Pilotage service to ships in distress. (3)Extraordinary pilotage service. (4)A pilot being carried to sea unwillingly. (5)The detention of a pilot. Proposed law retains present law. Present law requires pilotage fees and rates to provide for all ordinary and necessary operating and administrative costs and expenses. Proposed law changes the requirement to an authorization that pilotage fees and rates may provide for all ordinary and necessary operating and administrative costs and expenses. Effective upon signature of the governor or lapse of time for gubernatorial action. (Amends R.S. 34:1122(B)(1))
