Regular Session, 2014 HOUSE BILL NO. 1235 BY REPRESENTATIVE THIBAUT RACING/TRACKS: Provides relative to horse racing facilities AN ACT1 To amend and reenact R.S. 27:361(B)(4)(b) and (c) and 438(A), relative to funds derived2 from gaming operations at horse racing facilities; to provide relative to proceeds3 derived from slot machine gaming conducted at horse racing facilities; to provide4 relative to proceeds derived from gaming devices at horse racing facilities; and to5 provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 27:361(B)(4)(b) and 438(B) are hereby amended and reenacted to8 read as follows:9 §361. Conduct of slot machine gaming; temporary conduct10 * * *11 B. As a condition of licensing and to maintain continued authority for the12 conduct of slot machine gaming at the licensed eligible facility, the owner of the13 licensed eligible facility shall:14 * * *15 (4) Contribute to the support of pari-mutuel wagering facilities in the state16 at large and the horse breeding industry by paying annually from the annual net slot17 machine proceeds received from slot machine gaming operations at the licensed18 eligible facility as provided in this Paragraph:19 * * *20 HLS 14RS-2150 ORIGINAL HB NO. 1235 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (b) The licensed eligible facility shall pay annually a fixed percentage of two1 three percent of the annual net slot machine proceeds received from slot machine2 gaming operations at the licensed eligible facility to the Executive Committee of the3 Louisiana Thoroughbred Breeders' Association. The Executive Committee shall4 distribute such amount according to a schedule or formula and within a time period5 which shall be established by the committee for special breeder awards to the6 breeders of accredited Louisiana-bred horses.7 (c) The licensed eligible facility shall pay annually a fixed percentage of one8 three percent of the annual net slot machine proceeds received from slot machine9 gaming operations at the licensed eligible facility to the Executive Committee of the10 Louisiana Quarter Horse Breeders' Association. The Executive Committee shall11 distribute such amount according to a schedule or formula and within a time period12 which shall be established by the committee for special breeders' awards to the13 breeders of accredited Louisiana-bred quarter horses.14 * * * 15 §438. Distribution of device revenues; particular licensed establishments; pari-16 mutuel wagering facilities17 A. The owner of the licensed establishment shall pay twenty percent of the18 net device revenue derived from the operation of devices at that licensed19 establishment to be used to supplement purses for horsemen as provided in20 Subsection B of this Section and in addition to the four percent of the twenty percent21 distributed as provided in Subsection B of this Section, the owner of the licensed22 establishment shall pay an additional four tenths of one percent of the net device23 revenue derived from the operation of devices at the licensed establishment to the24 authorized representative of the Horsemen's Benevolent and Protective Association.25 Such monies shall be made available for use as purses monthly, prior to the twentieth26 day of the month following the month in which they are earned.27 * * *28 29 HLS 14RS-2150 ORIGINAL HB NO. 1235 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law provides that 4% of 20% of the net device revenue derived from the operation of video draw poker devices at parimutuel wagering facilities (OTBs) is paid to the authorized representative of the horsemen for the use and benefit of such persons and horsemen as medical and hospital benefits. Proposed law retains present law and provides an additional .4% of 100% of the net device revenue derived from the operation of video draw poker devices at OTBs to be paid to the Horsemen's Benevolent and Protective Association. Present law provides that 2% of the annual net slot machine proceeds received from slot machine gaming operations at the licensed eligible facility (slots at the track) is payable to the Executive Committee of the La. Thoroughbred Breeders Association for distribution by the committee in accordance with a schedule or formula for special breeder awards to the breeders of accredited La.-bred horses. Proposed law increases this amount from 2% to 3%. Present law also provides that 1% of the annual net slot machine proceeds received from slot machine gaming operations at the licensed eligible facility (slots at the track) is payable directly to the Executive Committee of the La. Quarter Horse Breeders Association for distribution by the committee in accordance with a schedule or formula for special breeder awards to the breeders of accredited La.-bred quarter horses.
