MTR VEHICLE/DRIVER LIC: Provides that drivers' licenses be renewed every six years
AN ACT1
To amend and reenact R.S. 32:412(A)(4)(a) and (b)(introductory paragraph), (7)(a) and2
(b)(introductory paragraph), (B)(7)(a)(i) and (ii)(introductory paragraph), (b)(i) and3
(ii)(introductory paragraph), (c)(i) and (ii)(introductory paragraph), (d)(i) and4
(ii)(introductory paragraph), (e)(i)(aa) and (bb)(introductory paragraph), and (dd)(I)5
and (II) and (ii)(aa) and (dd)(I) and (II), and (C), relative to duration of driver's6
licenses; to provide that driver's licenses be renewed every six years; and to provide7
for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. R.S. 32:412(A)(4)(a) and (b)(introductory paragraph), (7)(a) and10
(b)(introductory paragraph), (B)(7)(a)(i) and (ii)(introductory paragraph), (b)(i) and11
(ii)(introductory paragraph), (c)(i) and (ii)(introductory paragraph), (d)(i) and12
(ii)(introductory paragraph), (e)(i)(aa) and (bb)(introductory paragraph), and (dd)(I) and (II)13
and (ii)(aa) and (dd)(I) and (II), and (C), are hereby amended and reenacted to read as14
follows:15

commerce of Class "D" or "E" drivers' licenses; disposition of certain fees;18

(4)(a) A Class "D" driver's license shall expire on the anniversary of the1
birthday of the applicant which is nearest to a period of four six years subsequent to2
the issuing of the license, unless suspended, revoked, or canceled prior to that time.3
(b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,4
the department may issue the license for a period of less than four six years in5
circumstances of medical limitation, limitation on lawful presence, or other special6
restrictions. When the department issues a license to a properly documented alien7
student or nonresident alien, the license shall both:8

(7)(a) A Class "E" driver's license shall expire on the anniversary of the10
birthday of the applicant which is nearest to a period of four six years subsequent to11
the issuing of the license, unless suspended, revoked, or canceled.12
(b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,13
the department may issue the license for a period of less than four six years in14
circumstances of medical limitation, limitation on lawful presence, or other special15
restrictions. When the department issues a license to a properly documented alien16
student or nonresident alien, the license shall both:17

(7)(a)(i) A Class "C" commercial driver's license not carrying an21
endorsement permitting the transportation of material found to be hazardous for22
purposes of the Federal Hazardous Material Act, 49 United States Code 5101 et seq.23
or under state law or regulation shall expire on the anniversary of the birthday of the24
applicant which is nearest to a date of four six years subsequent to the issuing of the25
license, unless revoked, canceled, or suspended prior to that time.26
(ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the27

department may issue the license for a period of less than four six years in21
circumstances of medical limitation, limitation on lawful presence, or other special22

(d)(i)  A Class "A" commercial driver's license shall expire on the26
anniversary of the birthday of the applicant which is nearest to a date of four six27

circumstances of medical limitation, limitation on lawful presence, or other special3
restrictions. When the department issues a license to a properly documented alien4
student or nonresident alien, the license shall both:5

(e)(i)(aa) Every applicant seventy years of age or older for a Class "E"7
driver's license, or for the renewal of a Class "E" driver's license, except those bona8
fide residents of the city of New Orleans, shall pay for such basic license a fee of9
four dollars and fifty cents, which shall be the cost of the license. The license shall10
expire on the anniversary of the birthday of the applicant which is nearest to a date11
of four six years subsequent to the issuing of the license, unless revoked, canceled,12
or suspended.13
(bb) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(i)(aa), the14
department may issue the license for a period of less than four six years in15
circumstances of medical limitation, limitation on lawful presence, or other special16
restrictions. When the department issues a license to a properly documented alien17
student or nonresident alien, the license shall both:18

(dd)(I) Every applicant seventy years of age or older for a Class "D" driver's20
license, or for the renewal of a Class "D" driver's license, except those bona fide21
residents of the city of New Orleans, shall pay for such basic license a fee of fourteen22
dollars and seventy-five cents, which shall be the cost of the license.  The license23
shall expire on the anniversary of the birthday of the applicant which is nearest to the24
date of four six years subsequent to the issuing of the license, unless revoked,25
canceled, or suspended.26
(II) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(i)(dd)(I), the27
department may issue the license for a period of less than four six years in28

restriction. When the department issues a license to a properly documented alien1
student or nonresident alien, the license shall both expire on the date for which the2
alien's immigration documents expire, if sooner than the date specified in3
Subsubitem (I) of this Subitem, and contain a restriction code which declares that the4
license holder is an alien student or a nonresident alien.5

(ii)(aa) Every applicant seventy years of age or older for a Class "E" driver's7
license, or for the renewal of a Class "E" driver's license, issued to bona fide8
residents of the city of New Orleans, shall pay for such basic license a fee of four9
dollars and fifty cents, which shall be the cost of the license. This license shall expire10
on the anniversary of the birthday of the applicant which is nearest to the date of four11
six years subsequent to the issuing of the license, unless revoked, canceled, or12
suspended.13

(dd)(I) Every applicant seventy years of age or older for a Class "D" driver's15
license, or for the renewal of a Class "D" driver's license, issued to bona fide16
residents of the city of New Orleans, shall pay for such basic license a fee of17
eighteen dollars and fifty cents, which shall be the cost of the license. This license18
shall expire on the anniversary of the birthday of the applicant which is nearest to the19
date of four six years subsequent to the issuing of the license, unless revoked,20
canceled, or suspended.21
(II) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(ii)(dd)(I), the22
department may issue the license for a period of less than four six years in23
circumstances of medical limitation, limitation on lawful presence, or other special24
restriction. When the department issues a license to a properly documented alien25
student or nonresident alien, the license shall both expire on the date for which the26

Subsubitem (I) of this Subitem, and contain a restriction code which declares that the1
license holder is an alien student or a nonresident alien. 2

C.(1) The addition of a motorcycle or motor scooter endorsement to a basic4
license will require, besides the specific examination for such vehicles, the payment5
of an additional fee of eight dollars. If the motorcycle endorsement is to any license6
which is valid for less than four six years, the fee for the endorsement will be four7
dollars.8
(2) Notwithstanding any provisions of law to the contrary and subject to the9
exceptions contained in Article VII, Section 9(A) of the Constitution of Louisiana,10
the amount of five dollars from the fee for a motorcycle or motor scooter11
endorsement to a basic license, or the amount of two dollars from the fee if the12
motorcycle endorsement for any person is to a license that is valid for only less than13
four six years shall be credited to the Bond Security and Redemption Fund.  After14
a sufficient amount is allocated from that fund to pay all obligations secured by the15
full faith and credit of the state which become due and payable within any fiscal16
years, the treasurer shall pay an amount equal to the fees paid into the Bond Security17
and Redemption Fund pursuant to this Paragraph into a special fund which is hereby18
created in the state treasury and designated as the "Motorcycle Safety, Awareness,19
and Operator Training Program Fund", hereinafter referred to as the "fund".  The20
monies credited to the fund shall be used solely for operator training, instructor21
training, and motorcycle safety and awareness programs. Any unexpended and22
unencumbered monies remaining to the credit of the fund on June thirtieth of each23
year, after all appropriations of the preceding fiscal year have been made, shall revert24
to the state general fund. The monies in the fund shall be expended solely from year25
to year as appropriated by the legislature for the purposes of motorcycle safety and26
awareness and operator training. Any amounts earned through investment of the27
monies in the fund shall revert to the state general fund.28

Abstract: Changes the renewal period for driver's licenses from four years to six years.
Present law provides that a Class "D" and "E" driver's license expires on the anniversary of
the birthday of the applicant which is nearest to a period of four years subsequent to the
issuing of the license.
Proposed law changes the four-year period to a six-year period.
Present law provides that a Class "A", "B", and "C" commercial driver's license shall expire
on the anniversary of the birthday of the applicant which is nearest to a date of four years
subsequent to the issuing of the license.
Proposed law changes the four-year period to a six-year period.
Present law provides that the addition of a motorcycle or motor scooter endorsement to a
basic license will require the payment of an additional fee of $8. If the motorcycle
endorsement is to any license which is valid for less than four years, the fee for the
endorsement will be $4.
