Regular Session, 2014 HOUSE BILL NO. 1252 BY REPRESENTATIVE FOIL MTR VEHICLE/DRIVER LIC: Provides that drivers' licenses be renewed every six years AN ACT1 To amend and reenact R.S. 32:412(A)(1), (2), (3), (4)(a) and (b)(introductory paragraph),2 (5), (6), (7)(a) and (b)(introductory paragraph), (B)(1), (2), (5), (7)(a)(i) and3 (ii)(introductory paragraph), (b)(i) and (ii)(introductory paragraph), (c)(i) and4 (ii)(introductory paragraph), (d)(i) and (ii)(introductory paragraph), (e)(i)(aa),5 (bb)(introductory paragraph), (cc), (dd), and (ee), and (ii)(aa), (cc),(dd) and (ee) and6 (C), 32:412.1(B)(C)(D), and 32:429(A), to enact R.S. 32:412.1(E), and to repeal R.S.7 32:412.1(A)(1), relative to the duration of driver's licenses; to provide that driver's8 licenses be renewed every six years; and to provide for related matters.9 Be it enacted by the Legislature of Louisiana:10 Section 1. 32:412(A)(1), (2), (3), (4)(a) and (b)(introductory paragraph), (5), (6),11 (7)(a) and (b)(introductory paragraph), (B)(1), (2), (5), (7)(a)(i) and (ii)(introductory12 paragraph), (b)(i) and (ii)(introductory paragraph), (c)(i) and (ii)(introductory paragraph),13 (d)(i) and (ii)(introductory paragraph), (e)(i)(aa), (bb)(introductory paragraph), (cc), (dd),14 (ee), and (ii)(aa), (cc)(dd), and (ee) and (C), 32:412.1(B)(C)(D), and 32:429(A) are hereby15 amended and reenacted and R.S. 32:412.1(E) is hereby enacted to read as follows:16 §412. Amount of fees; credit or refund; duration of license; veteran designation;17 "I'm a Cajun" designation; disbursement of funds; renewal by mail or18 electronic commerce of Class "D" or "E" drivers' licenses; disposition of19 certain fees; exception20 A.(1) Every applicant for a Class "D" driver's license, or for a renewal of a21 Class "D" driver's license, except those bona fide residents of the city of New22 HLS 14RS-2316 ENGROSSED HB NO. 1252 Page 2 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Orleans, shall pay for such basic license a fee of twenty-eight dollars and fifty cents1 forty-two dollars and seventy-five cents. Seven dollars and forty three cents Eleven2 dollars and fifteen cents of the fee shall be paid to the State Police Pension and3 Retirement Fund. One dollar and fifty cents of the fee shall be forwarded by the4 department to the litter abatement and education account which is created with the5 Conservation Fund through the provisions of R.S. 56:10(B)(15). 6 (2) The fee for Class "D" driver's licenses, or renewal of a Class "D" driver's7 license, issued to bona fide residents of the city of New Orleans shall be thirty-six8 dollars fifty-four dollars, ten dollars fifteen dollars of which shall be payable by the9 department to the board of trustees of the police pension fund of the city of New10 Orleans. One dollar and twenty three cents eighty four cents of the fee shall be paid11 to the State Police Pension and Retirement Fund. One dollar and fifty cents of fee12 shall be forwarded by the department to the litter abatement and education account13 which is created within the Conservation Fund through the provisions of R.S.14 56:10(B)(15). 15 (3) There shall be a fee of five dollars seven dollars and fifty cents for an16 emergency vehicle endorsement for any vehicle group.17 * * *18 (4)(a) A Class "D" driver's license shall expire on the anniversary of the19 birthday of the applicant which is nearest to a period of four six years subsequent to20 the issuing of the license, unless suspended, revoked, or canceled prior to that time.21 (b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,22 the department may issue the license for a period of less than four six years in23 circumstances of medical limitation, limitation on lawful presence, or other special24 restrictions. Orleans, shall pay for such basic license a fee of thirteen dollars and fifty cents1 twenty dollars and twenty-five cents, which shall be the cost of such basic license.2 Three dollars and seventy-five cents Five dollars and sixty-three cents of the fee shall3 be paid to the State Police Pension and Retirement Fund. One dollar and fifty cents4 of the fee shall be forwarded by the department to the litter abatement and education5 account which is created within the Conservation Fund through the provisions of6 R.S. 56:10(B)(15). 7 (6) The fee for a Class "E" driver's license, or renewal of a Class "E" driver's8 license, issued to bona fide residents of the city of New Orleans shall be thirteen9 dollars and fifty cents, two dollars and fifty cents twenty dollars and twenty-five10 cents, three dollars and seventy-five cents of which fee shall be paid by the11 department to the board of trustees of the police pension funds of the city of New12 Orleans. Two dollars and fifty cents Three dollars and seventy-five cents of the fee13 shall be paid to the State Police Pension and Retirement Fund. One dollar and fifty14 cents of the fee shall be forwarded by the department to the litter abatement and15 education account which is created within the Conservation Fund through the16 provisions of R.S. 56:10(B)(15).17 (7)(a) A Class "E" driver's license shall expire on the anniversary of the18 birthday of the applicant which is nearest to a period of four six years subsequent to19 the issuing of the license, unless suspended, revoked, or canceled.20 (b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,21 the department may issue the license for a period of less than four six years in22 circumstances of medical limitation, limitation on lawful presence, or other special23 restrictions. Ten dollars and eighty cents sixty-one1 dollars and fifty cents. Sixteen dollars and twenty cents of the fee shall be paid to2 the State Police Pension and Retirement Fund. One dollar and fifty cents of the fee3 shall be forwarded by the department to the litter abatement and education account4 which is created within the Conservation Fund through the provisions of R.S.5 56:10(B)(15).6 (2) The fee for a basic Class "A", "B", or "C" commercial driver's license,7 or for the renewal of a basic Class "A", "B", or "C" commercial driver's license,8 issued to bona fide residents of the city of New Orleans shall be fifty one dollars, ten9 seventy-six dollars and fifty cents, fifteen dollars of which fee shall be paid by the10 department to the board of trustees of the police pension fund of the city of New11 Orleans. Ten Fifteen dollars of the fee shall be paid to the State Police Pension and12 Retirement Fund. One dollar and fifty cents of the fee shall be forwarded by the13 department to the litter abatement and education account which is created with the14 Conservation Fund through the provisions of R.S. 56:10(B)(15).15 * * *16 (5) There shall be a fee of five dollars seven dollars and fifty cents for each17 endorsement to the basic licenses listed in R.S. 32:408(B).18 * * *19 (7)(a)(i) A Class "C" commercial driver's license not carrying an20 endorsement permitting the transportation of material found to be hazardous for21 purposes of the Federal Hazardous Material Act, 49 United States Code 5101 et seq.22 or under state law or regulation shall expire on the anniversary of the birthday of the23 applicant which is nearest to a date of four six years subsequent to the issuing of the24 license, unless revoked, canceled, or suspended prior to that time.25 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the26 department may issue the license for a period of less than four six years in27 circumstances of medical limitations, limitation on lawful presence, or other special28 HLS 14RS-2316 ENGROSSED HB NO. 1252 Page 5 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. restrictions. When the department issues a license to a properly documented alien1 student or nonresident alien, the license shall both:2 * * *3 (b)(i) A Class "C" commercial driver's license carrying an endorsement4 permitting the transportation of materials found to be hazardous for purposes of the5 Federal Hazardous Material Act, 49 United States Code 5101 et seq. or under state6 law or regulation shall expire on the anniversary of the birthday of the applicant7 which is nearest to a date of four six years subsequent to the issuing of the license,8 unless revoked, canceled, or suspended prior to that time.9 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the10 department may issue the license for a period of less than four six years in11 circumstances of medical limitation, limitation on lawful presence, or other special12 restrictions. When the department issues a license to a properly documented alien13 student or nonresident alien, the license shall both:14 * * *15 (c)(i) A Class "B" commercial driver's license shall expire on the anniversary16 of the birthday of the applicant which is nearest to a date of four six years subsequent17 to the issuing of the license, unless revoked, canceled, or suspended prior to that18 time.19 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the20 department may issue the license for a period of less than four six years in21 circumstances of medical limitation, limitation on lawful presence, or other special22 restrictions. (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the1 department may issue the license for a period of less than four six years in2 circumstances of medical limitation, limitation on lawful presence, or other special3 restrictions. When the department issues a license to a properly documented alien4 student or nonresident alien, the license shall both:5 * * *6 (e)(i)(aa) Every applicant seventy years of age or older for a Class "E"7 driver's license, or for the renewal of a Class "E" driver's license, except those bona8 fide residents of the city of New Orleans, shall pay for such basic license a fee of9 four dollars and fifty cents six dollars and seventy-five cents, which shall be the cost10 of the license. The license shall expire on the anniversary of the birthday of the11 applicant which is nearest to a date of four six years subsequent to the issuing of the12 license, unless revoked, canceled, or suspended.13 (bb) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(i)(aa), the14 department may issue the license for a period of less than four six years in15 circumstances of medical limitation, limitation on lawful presence, or other special16 restrictions. When the department issues a license to a properly documented alien17 student or nonresident alien, the license shall both:18 * * *19 (cc) Fifty cents Seventy-five cents of the fee shall be paid to the office of20 state police. One dollar and fifty cents Two dollars and seventy-five cents of the fee21 shall be paid to the State Police Pension and Retirement Fund. One dollar and fifty22 cents of the fee shall be forwarded by the department to the litter abatement and23 education account which is created within the Conservation Fund through the24 provisions of R.S. 56:10(B)(15).25 (dd)(I) Every applicant seventy years of age or older for a Class "D" driver's26 license, or for the renewal of a Class "D" driver's license, except those bona fide27 residents of the city of New Orleans, shall pay for such basic license a fee of fourteen28 dollars and seventy-five cents twenty-two dollars and thirteen cents, which shall be29 HLS 14RS-2316 ENGROSSED HB NO. 1252 Page 7 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. the cost of the license. The license shall expire on the anniversary of the birthday of1 the applicant which is nearest to the date of four six years subsequent to the issuing2 of the license, unless revoked, canceled, or suspended.3 (II) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(i)(dd)(I), the4 department may issue the license for a period of less than four six years in5 circumstances of medical limitation, limitation on lawful presence, or other special6 restriction. When the department issues a license to a properly documented alien7 student or nonresident alien, the license shall both expire on the date for which the8 alien's immigration documents expire, if sooner than the date specified in9 Subsubitem (I) of this Subitem, and contain a restriction code which declares that the10 license holder is an alien student or a nonresident alien.11 (ee) Three dollars and seventy-one cents Five dollars and fifty-six cents of12 the fee shall be paid to the State Police Pension and Retirement Fund. One dollar and13 fifty cents of the fee shall be forwarded by the department to the litter abatement and14 education account which is created within the Conservation Fund through the15 provisions of R.S. 56:10(B)(15).16 (ii)(aa) Every applicant seventy years of age or older for a Class "E" driver's17 license, or for the renewal of a Class "E" driver's license, issued to bona fide18 residents of the city of New Orleans, shall pay for such basic license a fee of four19 dollars and fifty cents six dollars and seventy-five cents, which shall be the cost of20 the license. This license shall expire on the anniversary of the birthday of the21 applicant which is nearest to the date of four six years subsequent to the issuing of22 the license, unless revoked, canceled, or suspended.23 * * *24 (cc) One dollar and fifty cents of the fee shall be paid to the Board of25 Trustees of the Police Pension Fund of the city of New Orleans. One dollar and fifty26 cents of the fee shall be paid to the State Police Pension and Retirement Fund. When the department issues a license to a properly documented alien13 student or nonresident alien, the license shall both expire on the date for which the14 alien's immigration documents expire, if sooner than the date specified in15 Subsubitem (I) of this Subitem, and contain a restriction code which declares that the16 license holder is an alien student or a nonresident alien. 17 (ee) Five dollars Seven dollars and fifty cents of the fee shall be payable by18 the department to the board of trustees of the police pension fund of the city of New19 Orleans. Sixty-one cents Ninety-two cents of the fee shall be paid to the State Police20 Pension and Retirement Fund. One dollar and fifty cents of the fee shall be21 forwarded by the department to the litter abatement and education account which is22 created within the Conservation Fund through the provisions of R.S. 56:10(B)(15).23 * * *24 C.(1) The addition of a motorcycle or motor scooter endorsement to a basic25 license will require, besides the specific examination for such vehicles, the payment26 of an additional fee of eight twelve dollars. (2) Notwithstanding any provisions of law to the contrary and subject to the1 exceptions contained in Article VII, Section 9(A) of the Constitution of Louisiana,2 the amount of five dollars seven dollars and fifty cents from the fee for a motorcycle3 or motor scooter endorsement to a basic license, or the amount of two three dollars4 from the fee if the motorcycle endorsement for any person is to a license that is valid5 for only less than four six years shall be credited to the Bond Security and6 Redemption Fund. After a sufficient amount is allocated from that fund to pay all7 obligations secured by the full faith and credit of the state which become due and8 payable within any fiscal years, the treasurer shall pay an amount equal to the fees9 paid into the Bond Security and Redemption Fund pursuant to this Paragraph into a10 special fund which is hereby created in the state treasury and designated as the11 "Motorcycle Safety, Awareness, and Operator Training Program Fund", hereinafter12 referred to as the "fund". The monies credited to the fund shall be used solely for13 operator training, instructor training, and motorcycle safety and awareness programs.14 Any unexpended and unencumbered monies remaining to the credit of the fund on15 June thirtieth of each year, after all appropriations of the preceding fiscal year have16 been made, shall revert to the state general fund. The monies in the fund shall be17 expended solely from year to year as appropriated by the legislature for the purposes18 of motorcycle safety and awareness and operator training. Any amounts earned19 through investment of the monies in the fund shall revert to the state general fund.20 * * *21 §412.1. Handling charges22 * * *23 B. Except as provided in Subsection D, the office of motor vehicles shall24 collect, in addition to any fee authorized by law, a handling charge of twelve dollars25 for each of the following transactions: 26 (1) Class D and Class E drivers' licenses: 27 (a) New applications. 28 (b) Renewals. 29 HLS 14RS-2316 ENGROSSED HB NO. 1252 Page 10 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Additional handling charges of eight dollars may be established by the3 office of motor vehicles upon transactions not specifically named in Subsection A4 of this Section in accordance with procedures in the Administrative Procedure Act.5 C. D. Two Three dollars and seventy-five cents on Class "D" and "E"6 driver's license transactions, and two dollars and fifty cents of the fee charged for all7 other any handling fees charged or collected shall be forwarded to the state treasurer8 for deposit in to the Office of Motor Vehicles Customer Service and Technology9 Fund created pursuant to the provisions of R.S. 32:429.2. 10 D. E. A child who is in foster care, as defined in Article 603 of the Louisiana11 Children's Code, shall not be required to pay the handling fee or other charge in order12 to obtain a driver's license or identification card.13 * * *14 §429. Office of motor vehicles field offices; authorization of fees15 A.(1) The governing authority of any local governmental subdivision is16 hereby authorized to levy, by resolution, a fee for each service or transaction carried17 out as an operation of an office of motor vehicles field office that is not fully funded18 by the state. Except as provided in Paragraph (2) of this Subsection, the fee shall not19 exceed three dollars four dollars and fifty cents per service or transaction and shall20 be used solely to defray the cost of operations of that local field office, including but21 not limited to facility rental, utilities, and maintenance. The fee shall not be charged22 for the procurement or renewal of a motor vehicle registration license. 23 (2) The fee provided for in Paragraph (1) of this Subsection may be levied24 in an amount not to exceed four six dollars by the local governing authority of25 Orleans Parish. 26 Section 2. R.S. 32:412.1(A)(1) is hereby repealed in its entirety.27 Section 3. Proposed law changes the basic license fee of $28.50 to $42.75 and provides that $11.15 shall go to the State Police Pension and Retirement Fund and $1.50 shall be forwarded to the litter abatement and education account. Present law provides that the fee for Class "D" driver's licenses or renewal of a Class "D" driver's license issued to a resident of New Orleans shall be $36.00, and $10.00 shall be payable to the board of trustees of the police pension fund of the city of New Orleans. $1.23 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the $36.00 fee to $54.00, and provides that $15.00 shall be payable to the board of trustees of the police pension fund of the city of New Orleans. $1.84 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that there shall be a $5.00 fee for an emergency vehicle endorsement for any vehicle group. Proposed law raises the $5.00 fee to a $7.50 fee. Present law provides that a Class "D" and "E" driver's license expires on the anniversary of the birthday of the applicant which is nearest to a period of four years subsequent to the issuing of the license. Proposed law changes the four-year period to a six-year period. Present law provides that applicants for a Class "E" driver's license or for a renewal of a Class "E" driver's license, except bona fide residents of New Orleans, shall pay a basic license fee of $13.50. $3.75 shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for a Class "E" driver's license or renewal of a Class "E" driver's license, except for residents of New Orleans, from $13.50 to $20.25. $5.63 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that the fee for a Class "E" driver's license or for renewal of a Class "E" driver's license for a resident of New Orleans shall be $13.50. $2.50 of the fee shall be paid to the board of trustees of the police pension funds of the city of New Orleans, and $2.50 of the fee shall be paid to the State Police Pension and Retirement Fund. $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for a Class "E" driver's license or renewal of a Class "E" driver's license for a resident of New Orleans from $13.50 to $20.25, and $3.75 of the fee shall be paid to the board of trustees of the police pension funds of the city of New Orleans. $3.75 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that applicants for Class "A", "B", or "C" commercial driver's licenses or for renewal of those licenses, except for residents of New Orleans shall pay a basic license fee of $41.00. $10.80 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for Class "A", "B", and "C" driver's licenses or renewals of those licenses, except residents of New Orleans, from $41.00 to $61.00. $16.20 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that the fee for a basic Class "A", "B", or "C" driver's license or for the renewal of a Class "A", "B", or "C" driver's license for residents of New Orleans shall be $51.00. $10.00 of the fee shall be paid to the board of trustees of the police pension fund of the city of New Orleans, and $10.00 of the fee shall be paid to the State Police Pension and Retirement Fund. $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the fee for a basic Class "A", "B", or "C" driver's license or for renewals of such license for residents of New Orleans from $51.00 to $76.50. $15.00 of the fee shall be paid to the board of trustees of the police pension fund of the city of New Orleans, and $15.00 of the fee shall be paid to the State Police Pension and Retirement Fund. $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that there shall be a fee of $5.00 for each endorsement to the basic licenses listed in R.S. 32:408(B). Proposed law increases the $5.00 fee to $7.50. Present law provides that a Class "A", "B", and "C" commercial driver's license shall expire on the anniversary of the birthday of the applicant which is nearest to a date of four years subsequent to the issuing of the license. Proposed law changes the four-year period to a six-year period. Present law provides that every applicant 70 years of age or older for a Class "E" driver's license or for a renewal of a Class "E" driver's license, except bona fide residents of New Orleans, shall pay a basic license fee of $4.50. $0.50 of the fee shall be paid to the office of state police. $1.50 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for a person 70 years of age or older for a Class "E" driver's license or renewal of such license from $4.50 to $6.75. $0.75 of the fee shall be paid to the office of state police, $2.75 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that applicants 70 years of age or older for a Class "D" driver's license or for a renewal of such license , except residents of New Orleans, shall pay a basic license fee of $14.75. $3.71 shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law increases the basic license fee that applicants 70 years of age or older for a Class "D" driver's license or for renewal of a Class "D" driver's license who are residents of New Orleans from $18.50 to $27.75. $7.50 of the fee shall be payable to the board of trustees of the police pension fund of the city of New Orleans, $0.92 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 shall be forwarded to the litter abatement and education account. Present law provides that the addition of a motorcycle or motor scooter endorsement to a basic license will require the payment of an additional fee of $8.00. If the motorcycle endorsement is to any license which is valid for less than four years, the fee for the endorsement will be $4.00. Proposed law changes the four-year period to a six-year period and increases the additional fee of $8.00 to $12.00. Proposed law also changes the $4.00 endorsement fee to $6.00. Present law provides that $5 from the fee for a motorcycle or motor scooter endorsement to a basic license, or the amount of $2 from the fee if the motorcycle endorsement for any person is to a license that is valid for only less than four years shall be credited to the Bond Security and Redemption Fund. Proposed law changes the four-year period to a six-year period. Provides that $7.50 from the fee for a motorcycle or motor scooter endorsement to a basic license, or the amount of $3.00 from the fee if the motorcycle endorsement for any person is to a license that is valid for only less than four years shall be credited to the Bond Security and Redemption Fund. Present law provides that the office of motor vehicles shall collect a handling charge of $8.00 for new applications, renewals, duplicates, and valid without photo Class "D" and "E" drivers' licenses. Provides that $2.50 of the fee charged for any handling fee charged or collected shall be forwarded to the state treasurer for deposit into the Office of Motor Vehicles Customer Service and Technology Fund. Proposed law increases the handling fee for new applications, renewals, duplicates, and valid without photo Class "D" and "E" drivers' licenses to $12.00. Present law provides that the governing authority of any local government subdivision is authorized to levy a fee for each service or transaction carried out as an operation of an office of motor vehicles field office that is not fully funded by the state. Except as provided by present law, the fee shall not exceed $3.00 per service or transaction. The fee may be levied in an amount not to exceed $4.00 by the local governing authority of Orleans Parish. Proposed law provides that the fee charged by local government subdivisions for services and transactions carried out as operations of an office of motor vehicles field office shall not exceed $4.50, except as provided by present law. The fee may be levied in an amount not to exceed $6.00 by the local governing authority of Orleans Parish. Proposed law provides that this Act shall become effective February 1, 2015.
