Amount of fees; credit or refund; duration of license; veteran designation;1 "I'm a Cajun" designation; disbursement of funds; renewal by mail or2 electronic commerce of Class "D" or "E" drivers' licenses; disposition of3 certain fees; exception4 A.(1) Every applicant for a Class "D" driver's license, or for a renewal of a5 Class "D" driver's license, except those bona fide residents of the city of New6 Orleans, shall pay for such basic license a fee of twenty-eight dollars and fifty cents7 forty-two dollars and seventy-five cents. Seven dollars and forty three cents Eleven8 dollars and fifteen cents of the fee shall be paid to the State Police Pension and9 Retirement Fund. One dollar and fifty cents of the fee shall be forwarded by the10 department to the litter abatement and education account which is created with the11 Conservation Fund through the provisions of R.S. 56:10(B)(15). 12 (2) The fee for Class "D" driver's licenses, or renewal of a Class "D" driver's13 license, issued to bona fide residents of the city of New Orleans shall be thirty-six14 dollars fifty-four dollars, ten dollars fifteen dollars of which shall be payable by the15 department to the board of trustees of the police pension fund of the city of New16 Orleans. One dollar and twenty three cents eighty-four cents of the fee shall be paid17 to the State Police Pension and Retirement Fund. One dollar and fifty cents of fee18 shall be forwarded by the department to the litter abatement and education account19 which is created within the Conservation Fund through the provisions of R.S.20 56:10(B)(15). 21 (3) There shall be a fee of five dollars seven dollars and fifty cents for an22 emergency vehicle endorsement for any vehicle group.23 (4)(a) A Class "D" driver's license shall expire on the anniversary of the24 birthday of the applicant which is nearest to a period of four six years subsequent to25 the issuing of the license, unless suspended, revoked, or canceled prior to that time.26 (b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,27 the department may issue the license for a period of less than four six years in28 circumstances of medical limitation, limitation on lawful presence, or other special29 HLS 14RS-2316 REENGROSSED HB NO. 1252 Page 3 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. restrictions. When the department issues a license to a properly documented alien1 student or nonresident alien, the license shall both:2 * * *3 (5) Every applicant for a Class "E" driver's license, or for a renewal of a4 Class "E" driver's license, except those bona fide residents of the city of New5 Orleans, shall pay for such basic license a fee of thirteen dollars and fifty cents6 twenty dollars and twenty-f ive cents, which shall be the cost of such basic license.7 Three dollars and seventy-five cents Five dollars and sixty-three cents of the fee shall8 be paid to the State Police Pension and Retirement Fund. One dollar and fifty cents9 of the fee shall be forwarded by the department to the litter abatement and education10 account which is created within the Conservation Fund through the provisions of11 R.S. 56:10(B)(15). 12 (6) The fee for a Class "E" driver's license, or renewal of a Class "E" driver's13 license, issued to bona fide residents of the city of New Orleans shall be thirteen14 dollars and fifty cents, two dollars and fifty cents twenty dollars and twenty-f ive15 cents, three dollars and seventy-five cents of which fee shall be paid by the16 department to the board of trustees of the police pension funds of the city of New17 Orleans. Two dollars and fifty cents Three dollars and seventy-five cents of the fee18 shall be paid to the State Police Pension and Retirement Fund. When the department issues a license to a properly documented alien1 student or nonresident alien, the license shall both:2 * * *3 B.(1) Every applicant for a Class "A", "B", or "C" commercial driver's4 license, or for a renewal of a basic Class "A", "B", or "C" commercial driver's5 license, except for those bona fide residents of the city of New Orleans, shall pay for6 such basic license a fee of forty-one dollars. Ten dollars and eighty cents sixty-one7 dollars and fifty cents. Sixteen dollars and twenty cents of the fee shall be paid to8 the State Police Pension and Retirement Fund. One dollar and fifty cents of the fee9 shall be forwarded by the department to the litter abatement and education account10 which is created within the Conservation Fund through the provisions of R.S.11 56:10(B)(15).12 (2) The fee for a basic Class "A", "B", or "C" commercial driver's license,13 or for the renewal of a basic Class "A", "B", or "C" commercial driver's license,14 issued to bona fide residents of the city of New Orleans shall be fifty one dollars, ten15 seventy-six dollars and fifty cents, fifteen dollars of which fee shall be paid by the16 department to the board of trustees of the police pension fund of the city of New17 Orleans. Ten Fifteen dollars of the fee shall be paid to the State Police Pension and18 Retirement Fund. One dollar and fifty cents of the fee shall be forwarded by the19 department to the litter abatement and education account which is created with the20 Conservation Fund through the provisions of R.S. 56:10(B)(15).21 * * *22 (5) There shall be a fee of five dollars seven dollars and fifty cents for each23 endorsement to the basic licenses listed in R.S. 32:408(B).24 * * *25 (7)(a)(i) A Class "C" commercial driver's license not carrying an26 endorsement permitting the transportation of material found to be hazardous for27 purposes of the Federal Hazardous Material Act, 49 United States Code28 Transportation Act, 49 USC 5101 et seq. or under state law or regulation shall expire29 HLS 14RS-2316 REENGROSSED HB NO. 1252 Page 5 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. on the anniversary of the birthday of the applicant which is nearest to a date of four1 six years subsequent to the issuing of the license, unless revoked, canceled, or2 suspended prior to that time.3 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the4 department may issue the license for a period of less than four six years in5 circumstances of medical limitations, limitation on lawful presence, or other special6 restrictions. When the department issues a license to a properly documented alien7 student or nonresident alien, the license shall both:8 * * *9 (b)(i) A Class "C" commercial driver's license carrying an endorsement10 permitting the transportation of materials found to be hazardous for purposes of the11 Federal Hazardous Material Act, 49 United States Code Transportation Act, 49 USC12 5101 et seq. or under state law or regulation shall expire on the anniversary of the13 birthday of the applicant which is nearest to a date of four six years subsequent to the14 issuing of the license, unless revoked, canceled, or suspended prior to that time.15 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the16 department may issue the license for a period of less than four six years in17 circumstances of medical limitation, limitation on lawful presence, or other special18 restrictions. When the department issues a license to a properly documented alien1 student or nonresident alien, the license shall both:2 * * *3 (d)(i) A Class "A" commercial driver's license shall expire on the4 anniversary of the birthday of the applicant which is nearest to a date of four six5 years subsequent to the issuing of the license, unless revoked, canceled, or suspended6 prior to that time.7 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph, the8 department may issue the license for a period of less than four six years in9 circumstances of medical limitation, limitation on lawful presence, or other special10 restrictions. When the department issues a license to a properly documented alien11 student or nonresident alien, the license shall both:12 * * *13 (e)(i)(aa) Every applicant seventy years of age or older for a Class "E"14 driver's license, or for the renewal of a Class "E" driver's license, except those bona15 fide residents of the city of New Orleans, shall pay for such basic license a fee of16 four dollars and fifty cents six dollars and seventy-five cents, which shall be the cost17 of the license. The license shall expire on the anniversary of the birthday of the18 applicant which is nearest to a date of four six years subsequent to the issuing of the19 license, unless revoked, canceled, or suspended.20 (bb) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(i)(aa) Subitem21 (aa) of this Item, the department may issue the license for a period of less than four22 six years in circumstances of medical limitation, limitation on lawful presence, or23 other special restrictions. When the department issues a license to a properly24 documented alien student or nonresident alien, the license shall both:25 * * *26 (cc) Fifty cents Seventy-five cents of the fee shall be paid to the office of27 state police. One dollar and fifty cents Two dollars and seventy-five cents of the fee28 shall be paid to the State Police Pension and Retirement Fund. One dollar and fifty29 HLS 14RS-2316 REENGROSSED HB NO. 1252 Page 7 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. cents of the fee shall be forwarded by the department to the litter abatement and1 education account which is created within the Conservation Fund through the2 provisions of R.S. 56:10(B)(15).3 (dd)(I) Every applicant seventy years of age or older for a Class "D" driver's4 license, or for the renewal of a Class "D" driver's license, except those bona fide5 residents of the city of New Orleans, shall pay for such basic license a fee of fourteen6 dollars and seventy-five cents twenty-two dollars and thirteen cents, which shall be7 the cost of the license. The license shall expire on the anniversary of the birthday of8 the applicant which is nearest to the date of four six years subsequent to the issuing9 of the license, unless revoked, canceled, or suspended.10 (II) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(i)(dd)(I)11 Subitem (I) of this Item, the department may issue the license for a period of less12 than four six years in circumstances of medical limitation, limitation on lawful13 presence, or other special restriction. When the department issues a license to a14 properly documented alien student or nonresident alien, the license shall both expire15 on the date for which the alien's immigration documents expire, if sooner than the16 date specified in Subsubitem (I) of this Subitem, and contain a restriction code which17 declares that the license holder is an alien student or a nonresident alien.18 (ee) Three dollars and seventy-one cents Five dollars and fifty-six cents of19 the fee shall be paid to the State Police Pension and Retirement Fund. One dollar and20 fifty cents of the fee shall be forwarded by the department to the litter abatement and21 education account which is created within the Conservation Fund through the22 provisions of R.S. 56:10(B)(15).23 (ii)(aa) Every applicant seventy years of age or older for a Class "E" driver's24 license, or for the renewal of a Class "E" driver's license, issued to bona fide25 residents of the city of New Orleans, shall pay for such basic license a fee of four26 dollars and fifty cents six dollars and seventy-five cents, which shall be the cost of27 the license. One dollar and fifty5 cents of the fee shall be paid to the State Police Pension and Retirement Fund. One6 dollar and fifty cents of the fee shall be forwarded by the department to the litter7 abatement and education account which is created within the Conservation Fund8 through the provisions of R.S. 56:10(B)(15).9 (dd)(I) Every applicant seventy years of age or older for a Class "D" driver's10 license, or for the renewal of a Class "D" driver's license, issued to bona fide11 residents of the city of New Orleans, shall pay for such basic license a fee of12 eighteen dollars and fifty cents twenty-seven dollars and seventy-five cents, which13 shall be the cost of the license. This license shall expire on the anniversary of the14 birthday of the applicant which is nearest to the date of four six years subsequent to15 the issuing of the license, unless revoked, canceled, or suspended.16 (II) Notwithstanding the provisions of R.S. 32:412(B)(7)(e)(ii)(dd)(I)17 Subsubitem (I) of this Subitem, the department may issue the license for a period of18 less than four six years in circumstances of medical limitation, limitation on lawful19 presence, or other special restriction. When the department issues a license to a20 properly documented alien student or nonresident alien, the license shall both expire21 on the date for which the alien's immigration documents expire, if sooner than the22 date specified in Subsubitem (I) of this Subitem, and contain a restriction code which23 declares that the license holder is an alien student or a nonresident alien. 24 (ee) Five dollars Seven dollars and fifty cents of the fee shall be payable by25 the department to the board of trustees of the police pension fund of the city of New26 Orleans. Sixty-one cents Ninety-two cents of the fee shall be paid to the State Police27 Pension and Retirement Fund. One dollar and fifty cents of the fee shall be28 HLS 14RS-2316 REENGROSSED HB NO. 1252 Page 9 of 14 CODING: Words in struck through type are deletions from existing law; words underscored are additions. forwarded by the department to the litter abatement and education account which is1 created within the Conservation Fund through the provisions of R.S. 56:10(B)(15).2 * * *3 C.(1) The addition of a motorcycle or motor scooter endorsement to a basic4 license will require, besides the specific examination for such vehicles, the payment5 of an additional fee of eight twelve dollars. If the motorcycle endorsement is to any6 license which is valid for less than four six years, the fee for the endorsement will7 be four six dollars.8 (2) Notwithstanding any provisions of law to the contrary and subject to the9 exceptions contained in Article VII, Section 9(A) of the Constitution of Louisiana,10 the amount of five dollars seven dollars and fifty cents from the fee for a motorcycle11 or motor scooter endorsement to a basic license, or the amount of two three dollars12 from the fee if the motorcycle endorsement for any person is to a license that is valid13 for only less than four six years shall be credited to the Bond Security and14 Redemption Fund. After a sufficient amount is allocated from that fund to pay all15 obligations secured by the full faith and credit of the state which become due and16 payable within any fiscal years, the treasurer shall pay an amount equal to the fees17 paid into the Bond Security and Redemption Fund pursuant to this Paragraph into a18 special fund which is hereby created in the state treasury and designated as the19 "Motorcycle Safety, Awareness, and Operator Training Program Fund", hereinafter20 referred to as the "fund". The monies credited to the fund shall be used solely for21 operator training, instructor training, and motorcycle safety and awareness programs.22 Any unexpended and unencumbered monies remaining to the credit of the fund on23 June thirtieth of each year, after all appropriations of the preceding fiscal year have24 been made, shall revert to the state general fund. The monies in the fund shall be25 expended solely from year to year as appropriated by the legislature for the purposes26 of motorcycle safety and awareness and operator training. Handling charges1 A. Except as provided for in Subsection D E of this Section, the office of2 motor vehicles shall collect, in addition to any fee authorized by law, a handling3 charge of eight dollars for each of the following transactions:4 * * *5 B. Except as provided in Subsection E of this Section, the office of motor6 vehicles shall collect, in addition to any fee authorized by law, a handling charge of7 twelve dollars for each of the following Class D and E driver's license transactions.8 (1) New applications. 9 (2) Renewals. 10 (3) Duplicates. 11 (4) Valid without photo. 12 B. C. Additional handling charges of eight dollars may be established by the13 office of motor vehicles upon transactions not specifically named in Subsection14 Subsections A and B of this Section in accordance with procedures in the15 Administrative Procedure Act. 16 C. D. Two Three dollars and seventy-five cents on Class "D" and "E"17 driver's license transactions, and two dollars and fifty cents of the fee charged for all18 other any handling fees charged or collected shall be forwarded to the state treasurer19 for deposit in to the Office of Motor Vehicles Customer Service and Technology20 Fund created pursuant to the provisions of R.S. 32:429.2. 21 D. E. A child who is in foster care, as defined in Article 603 of the Louisiana22 Children's Code, shall not be required to pay the handling fee or other charge in order23 to obtain a driver's license or identification card.24 * * *25 §429. Except as provided in Paragraph (2) of this Subsection, the fee shall not1 exceed three dollars four dollars and fifty cents per service or transaction and shall2 be used solely to defray the cost of operations of that local field office, including but3 not limited to facility rental, utilities, and maintenance. The fee shall not be charged4 for the procurement or renewal of a motor vehicle registration license. 5 (2) The fee provided for in Paragraph (1) of this Subsection may be levied6 in an amount not to exceed four six dollars by the local governing authority of7 Orleans Parish. 8 Section 2. Proposed law changes the basic license fee of $28.50 to $42.75 and provides that $11.15 shall go to the State Police Pension and Retirement Fund and $1.50 shall be forwarded to the litter abatement and education account. Present law provides that the fee for Class "D" driver's licenses or renewal of a Class "D" driver's license issued to a resident of New Orleans shall be $36.00, and $10.00 shall be payable to the board of trustees of the police pension fund of the city of New Orleans. $1.23 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the $36.00 fee to $54.00, and provides that $15.00 shall be payable to the board of trustees of the police pension fund of the city of New Orleans. $1.84 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that there shall be a $5.00 fee for an emergency vehicle endorsement for any vehicle group. Proposed law raises the $5.00 fee to a $7.50 fee. Present law provides that a Class "D" and "E" driver's license expires on the anniversary of the birthday of the applicant which is nearest to a period of four years subsequent to the issuing of the license. Proposed law changes the four-year period to a six-year period. Present law provides that applicants for a Class "E" driver's license or for a renewal of a Class "E" driver's license, except bona fide residents of New Orleans, shall pay a basic license fee of $13.50. $3.75 shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for a Class "E" driver's license or renewal of a Class "E" driver's license, except for residents of New Orleans, from $13.50 to $20.25. $5.63 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that the fee for a Class "E" driver's license or for renewal of a Class "E" driver's license for a resident of New Orleans shall be $13.50. $2.50 of the fee shall be paid to the board of trustees of the police pension funds of the city of New Orleans, and $2.50 of the fee shall be paid to the State Police Pension and Retirement Fund. $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for a Class "E" driver's license or renewal of a Class "E" driver's license for a resident of New Orleans from $13.50 to $20.25, and $3.75 of the fee shall be paid to the board of trustees of the police pension funds of the city of New Orleans. $3.75 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that applicants for Class "A", "B", or "C" commercial driver's licenses or for renewal of those licenses, except for residents of New Orleans shall pay a basic license fee of $41.00. $10.80 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the basic license fee for Class "A", "B", and "C" driver's licenses or renewals of those licenses, except residents of New Orleans, from $41.00 to $61.00. $16.20 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that the fee for a basic Class "A", "B", or "C" driver's license or for the renewal of a Class "A", "B", or "C" driver's license for residents of New Orleans shall be $51.00. $10.00 of the fee shall be paid to the board of trustees of the police pension fund of the city of New Orleans, and $10.00 of the fee shall be paid to the State Police Pension and Retirement Fund. $1.00 of the fee shall be forwarded to the litter abatement and education account. Proposed law changes the fee for a basic Class "A", "B", or "C" driver's license or for renewals of such license for residents of New Orleans from $51.00 to $76.50. $15.00 of the fee shall be paid to the board of trustees of the police pension fund of the city of New Orleans, and $15.00 of the fee shall be paid to the State Police Pension and Retirement Fund. $1.50 of the fee shall be forwarded to the litter abatement and education account. Present law provides that there shall be a fee of $5.00 for each endorsement to the basic licenses listed in R.S. 32:408(B). Proposed law increases the $5.00 fee to $7.50. Present law provides that a Class "A", "B", and "C" commercial driver's license shall expire on the anniversary of the birthday of the applicant which is nearest to a date of four years subsequent to the issuing of the license. Present law provides that applicants 70 years of age or older for a Class "D" driver's license or for renewal of a Class "D" driver's license who are residents of New Orleans shall pay a basic license fee of $18.50. $5.00 of the fee shall be payable to the board of trustees of the police pension fund of the city of New Orleans, $0.61 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.00 shall be forwarded to the litter abatement and education account. Proposed law increases the basic license fee that applicants 70 years of age or older for a Class "D" driver's license or for renewal of a Class "D" driver's license who are residents of New Orleans from $18.50 to $27.75. $7.50 of the fee shall be payable to the board of trustees of the police pension fund of the city of New Orleans, $0.92 of the fee shall be paid to the State Police Pension and Retirement Fund, and $1.50 shall be forwarded to the litter abatement and education account. Present law provides that the addition of a motorcycle or motor scooter endorsement to a basic license will require the payment of an additional fee of $8.00. If the motorcycle endorsement is to any license which is valid for less than four years, the fee for the endorsement will be $4.00. Present law provides that $5 from the fee for a motorcycle or motor scooter endorsement to a basic license, or the amount of $2 from the fee if the motorcycle endorsement for any person is to a license that is valid for only less than four years shall be credited to the Bond Security and Redemption Fund. Proposed law changes the four-year period to a six-year period. Provides that $7.50 from the fee for a motorcycle or motor scooter endorsement to a basic license, or the amount of $3.00 from the fee if the motorcycle endorsement for any person is to a license that is valid for only less than four years shall be credited to the Bond Security and Redemption Fund. Present law provides that the office of motor vehicles shall collect a handling charge of $8.00 for new applications, renewals, duplicates, and valid without photo Class "D" and "E" drivers' licenses. Provides that $2.50 of the fee charged for any handling fee charged or collected shall be forwarded to the state treasurer for deposit into the Office of Motor Vehicles Customer Service and Technology Fund. Proposed law increases the handling fee for new applications, renewals, duplicates, and valid without photo Class "D" and "E" drivers' licenses to $12.00. Provides that $3.75 on Class "D" and "E" driver's license transactions, and $2.50 of the fee charged for all other handling fees shall be forwarded to the state treasurer for deposit into the Office of Motor Vehicles Customer Service and Technology Fund. Present law provides that the governing authority of any local government subdivision is authorized to levy a fee for each service or transaction carried out as an operation of an office of motor vehicles field office that is not fully funded by the state. Except as provided by present law, the fee shall not exceed $3.00 per service or transaction. The fee may be levied in an amount not to exceed $4.00 by the local governing authority of Orleans Parish. Proposed law provides that the fee charged by local government subdivisions for services and transactions carried out as operations of an office of motor vehicles field office shall not exceed $4.50, except as provided by present law. The fee may be levied in an amount not to exceed $6.00 by the local governing authority of Orleans Parish. Proposed law provides that this Act shall become effective February 1, 2015.
