BUILDING CODES: Makes changes to the oversight and adoption of updates to the state
uniform construction code
AN ACT1
To amend and reenact R.S. 40:1730.26(2) and to enact R.S. 40:1730.26(3), relative to the2
state uniform construction code; to provide for legislative oversight; to provide for3
adoption of updates; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 40:1730.26(2) is hereby amended and reenacted and R.S.6
40:1730.26(3) is hereby enacted to read as follows: 7
ยง1730.26. Adoption and promulgation of certain building codes and standards as8
state uniform construction code; procedures9
The council shall review, adopt, modify, and promulgate the building codes10
referenced in R.S. 40:1730.28 of this Part, provided that:11

(2) The council shall review, evaluate, and update the state uniform13
construction code no later than five years from the date of publication of the14
appropriate code as provided for in R.S. 40:1730.28.  The council shall submit the15
updated state uniform construction code to the House Committee on Commerce and16
the Senate Committee on Commerce, Consumer Protection, and International Affairs17
for oversight and approval at least ten days prior to the last day for the filing of18
legislation in the regular legislative session. Additionally, the council shall provide19

changes to the International Residential Code at the time of submission to the1
oversight committees.2
(3) The updated state uniform construction code shall not become effective3
until it is approved by the legislature by concurrent resolution while in session.  If4
the legislature fails to adopt the updated state uniform construction code, the most5
recent state uniform construction code shall remain in effect until the legislature6
approves an updated state uniform construction code.7

Abstract: Requires legislative oversight and approval of updates to the uniform state
construction code at least 10 days prior to deadline for filing bills and provides that
the updated code shall not become effective until approved by concurrent resolution.
Present law provides for a uniform state construction code and requires the Building Code
Council to review and update it no later than five years from the date of publication of the
appropriate code. Requires the council to submit the updated code to the House Committee
on Commerce and the Senate Committee on Commerce, Consumer Protection, and
International Affairs for oversight and approval.  Requires the council to provide all
legislative members with a summary of the major proposed changes.
Proposed law retains present law and requires legislative oversight and approval of updates
to the uniform state construction code at least 10 days prior to deadline for filing bills.
Proposed law further provides that the code not become effective until it is approved by the
legislature by concurrent resolution while in session. Provides that if the legislature fails to
adopt the updated code, the most recent code will remain in effect until the legislature
approves an updated code.
