SCHOOLS/EMPLOYEES: Requires school boards and charter school governing authorities
to offer to their employees the opportunity to participate in the La. Public Employees
Deferred Compensation Plan
AN ACT1
To enact R.S. 17:81(X) and 3996(B)(34), relative to public school employers; to require2
governing authorities of public schools to offer their employees the opportunity to3
participate in the state deferred compensation plan; and to provide for related4
matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 17:81(X) and 3996(B)(34) are hereby enacted to read as follows:7
§81.  General powers of local public school boards8

X. Each city, parish, or other local school board shall offer its employees the10
opportunity to participate in the Louisiana Public Employees Deferred Compensation11
Plan as established by R.S. 42:1301 et seq. The requirement of this Subsection does12
not prohibit a school board from offering its employees the opportunity to participate13
in other plans established pursuant to Section 457 of the Internal Revenue Code.14

B. Notwithstanding any state law, rule, or regulation to the contrary and18

charter school established and operated in accordance with the provisions of this1
Chapter and its approved charter and the school's officers and employees shall be2
exempt from all statutory mandates or other statutory requirements that are3
applicable to public schools and to public school officers and employees except for4
the following laws otherwise applicable to public schools with the same grades:5

Section 2. This Act shall become effective upon signature by the governor or, if not9
signed by the governor, upon expiration of the time for bills to become law without signature10
by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.  If11
vetoed by the governor and subsequently approved by the legislature, this Act shall become12
effective on the day following such approval.13

Abstract: Requires school boards and governing authorities of charter schools to offer their
employees the opportunity to participate in the state's deferred compensation plan.
Present law, pursuant to federal tax law, provides for a deferred compensation plan for
public employees, which allows an employee to defer and invest some of his income.
Employees of political subdivisions, such as school boards, are eligible to participate in the
plan.
Proposed law requires school boards and governing authorities of charter schools to offer
their employees the opportunity to participate in the deferred compensation plan established
by present law. Provides that proposed law does not prohibit such employers from offering
opportunities to participate in other deferred compensation plans.
Effective upon signature of governor or lapse of time for gubernatorial action.
