HOUSE BILL NO. 244
BY REPRESENTATIVE BROADWATER
COLLEGES/UNIVERSITIES: Provides with respect to the lease of property at public
postsecondary education institutions to nonprofit corporations or associations to hold
fundraisers that include the auctioning and sale of firearms
AN ACT1
To amend and reenact R.S. 14:95.2(C)(3) and to enact R.S. 17:3361.1, relative to facilities2
of public postsecondary education insitutions; to provide with respect to leases to3
nonprofit corporations or associations to hold fundraisers that include the auctioning4
or sale of firearms; to provide with respect to conditions of such leases; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 14:95.2(C)(3) is hereby amended and reenacted to read as follows:8
§95.2. Carrying a firearm or dangerous weapon by a student or nonstudent on9
school property, at school-sponsored functions, or in a firearm-free zone10

C.  The provisions of this Section shall not apply to:12

(3) Any person having the written permission of the principal or as provided14
in R.S. 17:3361.1.15

Section 2.  R.S. 17:3361.1 is hereby enacted to read as follows:17

§3361.1.  Leases for fundraisers that involve firearms1
A. If property at a public postsecondary education institution is leased to a2
nonprofit corporation or association for the purpose of holding a fundraising event,3
the lease may authorize and provide for the auction and sale of firearms at the event.4
B.  Any such lease shall include at a minimum the following conditions:5
(1) The firearms to be auctioned are exhibited in a static display at the event.6
(2)  Campus security is present at the event.7
(3)  The event shall be held indoors.8

Abstract: Provides with respect to leases of property at a public college or university to
nonprofit corporations or associations to hold fundraisers that include the auctioning
and sale of firearms.
Present law provides with respect to the authority of management boards to grant leases of
any portion or portions of the grounds or campus of any college or university or of other
immovable property under its supervision and management.
Proposed law provides that if property at a public postsecondary education institution is
leased to a nonprofit corporation or association for the purpose of holding a fundraising
event, the lease may authorize and provide for the auction and sale of firearms at the event.
Further provides that any such lease shall include at a minimum the following conditions:
(1)  The firearms to be auctioned are exhibited in a static display.
(2)Campus security is present at the event.
(3)  The event shall be held indoors.
Present law provides that carrying a firearm, or dangerous weapon at a school sponsored
function, or in a firearm-free zone is unlawful.  Present law provides for certain exceptions.
Proposed law adds proposed law to list of exceptions.
