Regular Session, 2014 HOUSE BILL NO. 254 BY REPRESENTATIVE LORUSSO LEASES: Provides relative to leasing of certain marina facilities operated by Jefferson Parish AN ACT1 To enact R.S. 41:1224.1, relative to leases of certain marina property operated by Jefferson2 Parish; to exempt such leases from general requirements for advertising and bidding;3 and to provide for related matters.4 Notice of intention to introduce this Act has been published5 as provided by Article III, Section 13 of the Constitution of6 Louisiana.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 41:1224.1 is hereby enacted to read as follows:9 ยง1224.1. Exceptions to advertisement and bidding requirements10 The provisions of this Chapter do not apply to the lease or sublease of11 facilities of the Bucktown Marina that are owned and operated by the governing12 authority of Jefferson Parish pursuant to a lease between the state and the parish.13 Section 2. This Act shall become effective upon signature by the governor or, if not14 signed by the governor, upon expiration of the time for bills to become law without signature15 by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. Present law establishes procedures applicable to the lease of public property; generally requires the public entity to publicly advertise the proposed lease to solicit bidders and requires the awarding of the lease to the highest bidder who meets the requirements of law. Provides relative to terms and renewals of such leases. Provides exceptions. Proposed law provides an additional exception from present law applicable to the Bucktown Marina in Jefferson Parish. Otherwise retains present law. Effective upon signature of governor or lapse of time for gubernatorial action. (Adds R.S. 41:1224.1)
