PUBLIC HEALTH: Provides relative to preparation of cane syrup in the traditional manner
for public consumption
AN ACT1
To amend and reenact R.S. 40:4.9(A)(1)(a) and (B), relative to certain food products2
prepared in the home for public consumption; to provide for application of the state3
Sanitary Code; to provide for preparation of cane syrup in the traditional manner for4
sale; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 40:4.9(A)(1)(a) and (B) are hereby amended and reenacted to read7
as follows: 8
ยง4.9. Jellies, preserves, jams, honey, honeycomb products, 	cane syrup, cakes, and9
cookies; preparation in home for public consumption10
A.(1)(a) No provision of the state Sanitary Code or any provision of any11
other law or regulation that requires any equipment, design, construction, utensils,12
supplies, preparation, or services shall apply to the preparation of jellies, preserves,13
jams, honey, honeycomb products, cane syrup, cakes, and or cookies in the home for14
sale.  For purposes of this Section, with respect to preparation of cane syrup, "the15
home" shall mean, in addition to a dwelling, an open-sided structure on private16
property that shelters a cast iron kettle, evaporator, or other equipment for preparing17
cane syrup in the traditional manner. This Section shall not be construed to allow the18
sale or distribution of any unwholesome food.19

B. This Section shall not apply to any 	preparers preparer of jellies, preserves,1
jams, honey, honeycomb products, cane syrup, cakes, and or cookies which are made2
at a home for sale, whose gross annual sales equal twenty thousand dollars or more.3

Abstract: Provides relative to preparation of cane syrup in the traditional manner for public
consumption.
Present law provides that neither the state Sanitary Code nor any code, law, or regulation
providing requirements relative to commercial food preparation shall apply to the
preparation of jellies, preserves, jams, honey, honeycomb products, cakes, and cookies in
the home for sale. However, provides special restrictions on preparation of cakes and
cookies. Provides further that the exception to food preparation regulations shall not apply
to any home-based food preparer whose gross annual sales equal $20,000 or more.
Proposed law retains present law and extends application of the exception to food
preparation regulations to home-based preparers of cane syrup for sale. Provides that for the
purposes of proposed law, with respect to preparation of cane syrup, "the home" shall mean,
in addition to a dwelling, an open-sided structure on private property that shelters a cast iron
kettle, evaporator, or other equipment for preparing cane syrup in the traditional manner.
