CRIME: Increases the possible term of imprisonment for the crime of aggravated flight
from an officer
AN ACT1
To amend and reenact R.S. 14:108.1(E), relative to the crime of flight from an officer; to2
increase the possible term of imprisonment for the crime of aggravated flight from3
an officer; to provide for increased penalties when the crime results in serious bodily4
injury; to provide for a definition of "serious bodily injury"; and to provide for5
related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 14:108.1(E) is hereby amended and reenacted to read as follows: 8
ยง108.1.  Flight from an officer; aggravated flight from an officer9

E.(1) Whoever commits aggravated flight from an officer shall be11
imprisoned at hard labor for not more than two five years and may be fined not more12
than two thousand dollars.13
(2)(a) Whoever commits the crime of aggravated flight from an officer that14
results in serious bodily injury shall be imprisoned at hard labor for not more than15
ten years and may be fined not more than two thousand dollars.16
(b) For purposes of this Section, "serious bodily injury" means bodily injury17

disfigurement, or protracted loss or impairment of the function of a bodily member,1
organ, or mental faculty, or a substantial risk of death.2

Abstract: Increases the possible term of imprisonment for the crime of aggravated flight
from an officer to not more than five years and not more than ten years if the crime
results in serious bodily injury.
Present law defines the crime of aggravated flight from an officer as the intentional refusal
of a driver to bring a vehicle to a stop or of an operator to bring a watercraft to a stop, under
circumstances wherein human life is endangered, knowing that he has been given a visual
and audible signal to stop by a police officer when the officer has reasonable grounds to
believe that the driver or operator has committed an offense.
Present law provides that any person who commits such offense may be fined not more than
$2,000 and shall be imprisoned for not more than two years.
Proposed law increases the possible term of imprisonment for the commission of aggravated
flight from an officer from not more than two years to not more than five years and, if the
crime results in serious bodily injury, up to 10 years.  
Proposed law defines "serious bodily injury".
