Regular Session, 2014 HOUSE BILL NO. 316 BY REPRESENTATIVE BURFORD MTR VEHICLE/INSPECTION: Exempts single axle two-wheel trailers from motor vehicle inspection requirements AN ACT1 To amend and reenact R.S. 32:1311(B), (C), and (D), and to enact R.S. 32:1311(E), relative2 to motor vehicle inspection requirements; to remove the requirement that single axle3 two-wheel trailers bear a valid safety inspection certificate; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:1311(B), (C), and (D) are hereby amended and reenacted and R.S.7 32:1311(E) is hereby enacted to read as follows:8 ยง1311. Exemptions 9 * * * 10 B. Single axle two-wheel trailers and semitrailers are exempt from the11 inspection requirements of this Chapter.12 C. Motor vehicles which are less than twenty-five years old or older and13 which are used primarily for exhibition in shows, parades, tours, and other special14 uses and not for general transportation and which are registered and licensed as15 antique as provided in R.S. 32:707(L) shall be exempt from the inspection16 requirements of this Chapter.17 C. D. E.(1) Commercial motor vehicle truck tractors, trailers, and semitrailers1 in interstate commerce which are subject to the Federal Motor Carrier Safety2 Regulations shall be exempt from the inspection requirements of this Chapter3 provided that these commercial motor vehicles shall comply with the requirements4 of the Code of Federal Regulations (49 CFR 396.17) requiring periodic and annual5 inspections of commercial motor vehicles.6 (2) As an alternate means of compliance with the requirements of 49 CFR,7 the owner or operator of a commercial motor vehicle truck tractor may opt to obtain8 a Louisiana commercial motor vehicle inspection certificate which satisfies the9 requirements of 49 CFR 396.17. A trailer or semitrailer being used in combination10 with a truck tractor meeting such exemption may opt to obtain a Louisiana11 commercial motor vehicle inspection certificate which satisfies the requirements of12 49 CFR 396.17.13 (3) As used in this Subsection, "commercial motor vehicle" means any self-14 propelled truck tractor or towed vehicle which is used on public highways to15 transport property in interstate commerce, has been issued an apportioned plate16 through the International Registration Plan; and17 (a) Has a gross vehicle weight rating (GVWR) or gross combination weight18 rating (GCWR) of 10,001 pounds or more; or19 (b) Is used in the transportation of hazardous materials in a quantity20 placarding under regulations issued by the secretary under the Hazardous21 Transportation Act (49 USC app. 1801-1813). 22 DIGEST The digest printed below was prepared by House Legislative Services.
