Regular Session, 2014 HOUSE BILL NO. 316 BY REPRESENTATIVES BURFORD, BROWN, COX, GUINN, HILL, HONORE, HOWARD, AND PYLANT MTR VEHICLE/INSPECTION: Exempts single axle two-wheel trailers from motor vehicle inspection requirements AN ACT1 To amend and reenact R.S. 32:1311(B), (C), and (D) and to enact R.S. 32:1311(E), relative2 to motor vehicle inspection requirements; to remove the requirement that single axle3 two-wheel trailers bear a valid safety inspection certificate; and to provide for related4 matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:1311(B), (C), and (D) are hereby amended and reenacted and R.S.7 32:1311(E) is hereby enacted to read as follows:8 ยง1311. Exemptions 9 * * * 10 B. Single axle two-wheel trailers are exempt from the inspection11 requirements of this Chapter.12 C. C. D. Motor vehicles which display a current safety inspection sticker as1 certified by the Department of Public Safety and Corrections shall be exempt from2 the inspection requirements of this Chapter.3 D. E.(1) Commercial motor vehicle truck tractors, trailers, and semitrailers4 in interstate commerce which are subject to the Federal Motor Carrier Safety5 Regulations shall be exempt from the inspection requirements of this Chapter6 provided that these commercial motor vehicles shall comply with the requirements7 of the Code of Federal Regulations (49 CFR 396.17) requiring periodic and annual8 inspections of commercial motor vehicles.9 (2) As an alternate means of compliance with the requirements of 49 CFR,10 the owner or operator of a commercial motor vehicle truck tractor may opt to obtain11 a Louisiana commercial motor vehicle inspection certificate which satisfies the12 requirements of 49 CFR 396.17. A trailer or semitrailer being used in combination13 with a truck tractor meeting such exemption may opt to obtain a Louisiana14 commercial motor vehicle inspection certificate which satisfies the requirements of15 49 CFR 396.17.16 (3) As used in this Subsection, "commercial motor vehicle" means any self-17 propelled truck tractor or towed vehicle which is used on public highways to18 transport property in interstate commerce, has been issued an apportioned plate19 through the International Registration Plan; and20 (a) Has a gross vehicle weight rating (GVWR) or gross combination weight21 rating (GCWR) of 10,001 pounds or more; or22 (b) Is used in the transportation of hazardous materials in a quantity23 placarding under regulations issued by the secretary under the Hazardous Materials24 Transportation Act (49 USC app. 1801-1813). 25 HLS 14RS-550 REENGROSSED HB NO. 316 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
