INSURANCE/AUTOMOBILE:  Requires notice to an employee when an employer has
declined certain insurance coverage
AN ACT1
To enact R.S. 22:1295(1)(a)(v), relative to rejection of uninsured motorist coverage; to2
require an employer who rejects uninsured motorist coverage for vehicles provided3
to employees to provide the employees notice of the rejection; to provide that an4
employer is not required to obtain uninsured motorist coverage on a motor vehicle5
provided to an employee; to provide that the employer and insurer have no liability6
for failure to provide uninsured motorist coverage on a motor vehicle provided to an7
employee; and to provide for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1.  R.S. 22:1295(1)(a)(v) is hereby enacted to read as follows:10
ยง1295.  Uninsured motorist coverage11
The following provisions shall govern the issuance of uninsured motorist12
coverage in this state:13

(v) An employer who rejects coverage and who provides a vehicle to his16
employees for business use shall provide written notice to his employees that the17
employer-provided vehicle does not have uninsured motorist coverage.  An employer18
is not required to provide uninsured motorist coverage on an  employer-provided19

liability for uninsured motorist coverage resulting from the failure to provide the1
notice required herein.2

Abstract: Requires an employer to provide notice to employees when the employer rejects
uninsured motorist coverage on vehicles the employer provides to employees.
Present law requires uninsured motorist coverage be included in all automobile liability
policies issued in La. unless affirmatively rejected by the policyholder.
Proposed law retains present law but adds a requirement that an employer provide notice to
employees that vehicles furnished by the employer for use by employees do not have
uninsured motorist coverage.
Proposed law provides that neither the employer nor the insurer have liability for the failure
of the employer to provide the required notice to an employee.
(Adds R.S. 22:1295(1)(a)(v))

Committee Amendments Proposed by House Committee on Insurance to the original
bill.
1. Deleted penalty for employers who fail to provide the required notice and
provided that neither employers nor their insurers have liability for failing to
provide an employee with the required notice.
