ACT No. 162 Regular Session, 2014 HOUSE BILL NO. 324 BY REPRESENTATIVE LEGER AN ACT1 To amend and reenact R.S. 12:2.1, relative to certain confidential data in the possession of2 the Department of State; to authorize the disclosure of electronic mail addresses and3 short message service numbers to certain persons and entities; to provide for the use4 of the data; to provide for the maintenance of the confidentiality of the data; and to5 provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 12:2.1 is hereby amended and reenacted to read as follows: 8 ยง2.1. Electronic mail addresses and short message service numbers; confidentiality9 A. Any electronic mail address or short message service number submitted10 to or captured by the secretary of state pursuant to the provisions of this Title shall11 be confidential and shall not be disclosed by the secretary of state or any employee12 or official of the Department of State.13 B. The provisions of Subsection A of this Section shall not prohibit the14 disclosure of electronic mail addresses or short message service numbers by the15 secretary of state or any employee or official of the Department of State to an16 agency, official, or employee of state government or of a political subdivision of the17 state in the course of the interaction of the agency, official, or employee with the18 Department of State. An agency, official, or employee that receives electronic mail19 addresses or short message service numbers pursuant to this Subsection shall use the20 electronic mail addresses or short message service numbers only for the21 governmental purposes for which the information was submitted or captured, shall22 not disclose the electronic mail addresses or short message service numbers, and23 ENROLLEDHB NO. 324 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. shall maintain the confidentiality of the electronic mail addresses and short message1 service numbers.2 Section 2. This Act shall become effective upon signature by the governor or, if not3 signed by the governor, upon expiration of the time for bills to become law without signature4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
