BY REPRESENTATIVES BADON, HONORE, HOWARD, AND PYLANT
MOTOR VEHICLES: Exempts boat trailers from the requirement to have inspection
stickers
AN ACT1
To amend and reenact R.S. 32:1301 and 1311(D) and to enact R.S. 32:1311(E), relative to2
trailer inspections; to exempt certain trailers from requirement to bear a safety3
inspection certificate; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 32:1301 and 1311(D) are hereby amended and reenacted and R.S.6
32:1311(E) is hereby enacted to read as follows:7
§1301.  Vehicles without required equipment or in unsafe condition8
No person shall drive or move on any highway any motor vehicle, low-speed9
vehicle as defined in R.S. 32:1(40), trailer, semitrailer, or pole trailer, or any10
combination thereof, unless the equipment upon any such vehicle is in good working11
order and adjustment as required in this Chapter and said vehicle is in such safe12
mechanical condition as not to endanger the driver or other occupant or any person13
upon the highway.  Every motor vehicle, low-speed vehicle, trailer, semitrailer, and14
pole trailer registered in this state shall bear a valid safety inspection certificate15
issued in the state of Louisiana, except as otherwise provided by 	R.S. 32:1305(G)16
this Chapter.17

§1311.  Exemptions1

D.  Boat trailers shall be exempt from the inspection requirements of this3
Chapter.4
E.(1)  Commercial motor vehicle truck tractors, trailers, and semitrailers in5
interstate commerce which are subject to the Federal Motor Carrier Safety6
Regulations shall be exempt from the inspection requirements of this Chapter7
provided that these commercial motor vehicles shall comply with the requirements8
of the Code of Federal Regulations (49 CFR 396.17) requiring periodic and annual9
inspections of commercial motor vehicles.10
(2) As an alternate means of compliance with the requirements of 49 CFR,11
the owner or operator of a motor vehicle truck tractor may opt to obtain a Louisiana12
motor commercial motor vehicle inspection certificate which satisfies the13
requirements of 49 CFR 396.17. A trailer or semitrailer being used in combination14
with a truck tractor meeting such exemption may opt to obtain a Louisiana15
commercial motor vehicle inspection certificate which satisfies the requirements of16
49 CFR 396.17.17
(3) As used in this Section, "commercial motor vehicle" means any self-18
propelled truck tractor or towed vehicle which is used on public highways to19
transport property in interstate commerce, has been issued an apportioned plate20
through the International Registration Plan; and 21
(a) Has a gross vehicle weight rating (GVWR) or gross combination weight22
rating (GCWR) of 10,001 pounds or more; or 23
(b) Is used in the transportation of hazardous materials in quantity requiring24
placarding under regulations issued by the secretary under the Hazardous Materials25
