HOUSE BILL NO. 361

PROPERTY/PUBLIC:  Provides for the authority to transfer or lease certain state property
in St. Mary Parish
AN ACT1
To authorize and provide for the transfer of certain state property; to authorize the transfer2
of certain state property in St. Mary Parish; to provide for the property description;3
to provide for reservation of mineral rights; to provide terms and conditions; to4
provide an effective date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. The commissioner of administration, notwithstanding any other provision7
of law to the contrary, is hereby authorized and empowered to convey, transfer, assign, lease8
or deliver any interest, excluding mineral rights, the state may have to all or any portion of9
the following described parcel of property to Lawrence Toups, Gloria Toups, Perry Toups,10
and Erin Toups:11
Property acquired by the State through that certain tax sale for nonpayment of 194212
taxes assessed in the name of MRS. SIDNEY D. HANSON, recorded on June 26,13
1943, in Book 6-I Page 340 Entry No. 70080, described as "Lot Street, Road,14
Robertson, Smith." Said property being more fully described as "Lot 11 of the D.15
C. Roberts Addition to the Town of Berwick, Louisiana".16
Section 2. The commissioner of administration is hereby authorized to enter into17
such agreements, covenants, conditions, and stipulations and to execute such documents as18
necessary to properly effectuate any conveyance, transfer, assignment, lease or delivery of19
title, excluding mineral rights, to the property described in Section 1 of this Act, and as more20
specifically described in any such agreements entered into and documents executed by and21 HLS 14RS-675	REENGROSSED

between the commissioner of administration and Lawrence Toups, Gloria Toups, Perry1
Toups, and Erin Toups, in exchange of consideration proportionate to the appraised value2
of the property.  Any conveyance, transfer, assignment, lease, or delivery of title provided3
for in this Act shall be subject to and the land burdened with a right of way grant by the4
commissioner of administration through the State Land Office to the town of Berwick for5
an all purpose servitude as identified on a survey plat prepared by Terral J. Martin, Jr.6
Professional Land Surveyor bearing date January 1, 2014, revised, January 15, 2014. In the7
event that Lawrence Toups, Gloria Toups, Perry Toups, and Erin Toups do not acquire the8
property described in Section 1 of this Act on or before December 31, 2017, the9
authorization to convey, transfer, assign, lease, or deliver any interest in that property shall10
terminate and be null and void on that date.11
Section 3. This Act shall become effective upon signature by the governor or, if not12
signed by the governor, upon expiration of the time for bills to become law without signature13
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If14
vetoed by the governor and subsequently approved by the legislature, this Act shall become15
effective on the day following such approval.16
