HLS 14RS-222 ENGROSSED Page 1 of 2 Regular Session, 2014 HOUSE BILL NO. 398 BY REPRESENTATIVE STOKES PUBLIC LANDS/STATE: Provides for the lease of state property in Jefferson Parish AN ACT1 To authorize and provide for the leasing of certain state property in Jefferson Parish; to2 provide for the property description; to provide for reservation of mineral rights; to3 provide terms and conditions; to provide for letting a contract by a request for4 proposals by the city of Kenner; to provide an effective date; and to provide for5 related matters.6 Notice of intention to introduce this Act has been published7 as provided by Article III, Section 13 of the Constitution of8 Louisiana.9 Be it enacted by the Legislature of Louisiana:10 Section 1. The commissioner of administration, notwithstanding any other provision11 of law to the contrary, is hereby authorized and empowered to lease any interest, excluding12 mineral rights, the state may have to all or any portion of the following described parcel of13 property to the responsible offerer whose proposal resulted in a contract award by the city14 of Kenner:15 Description of a 15.646 acre parcel of land located in the Parish of Jefferson,16 State of Louisiana in accordance with a plan entitled SURVEY SHOWING STATE17 LEASE AMENDMENT 5 FOR THE CITY OF KENNER, LOCATED IN LAKE18 PONTCHARTRAIN, JEFFERSON PARISH, LOUISIANA DATED JUNE 15,19 2012.20 Section 2. The commissioner of administration is hereby authorized to enter into21 such agreements, covenants, conditions, and stipulations and to execute such documents as22 necessary to properly effectuate any lease, excluding mineral rights, of the property23 described in Section 1 of this Act, and as more specifically described in any such agreements24 entered into and documents executed by and between the commissioner of administration25 HLS 14RS-222 ENGROSSED HB NO. 398 Page 2 of 2 and the responsible offerer whose proposal resulted in a contract award by the city of1 Kenner, in exchange of consideration not less than seven percent of the appraised value of2 the property to be paid biannually to the state. In making an award to the responsible3 offerer, the city of Kenner shall follow the applicable procedures for letting a contract by a4 request for proposals provided in R.S. 39:1593(C)(2). An award shall be made to the5 responsible offerer whose proposal is determined in writing by the city of Kenner to be the6 most advantageous to the state, taking into consideration review of price and the evaluation7 factors set forth in the request for proposals. The city of Kenner shall consult with the office8 of state purchasing in the division of administration in conducting the request for proposals9 and shall include the office of state purchasing in the review of the request for proposal and10 attendance at sessions of the evaluation committee. No offerer shall receive an award or a11 lease for a proposal that could potentially create a negative impact on hurricane and flood12 protection for the parish of Jefferson.13 Section 3. This Act shall become effective upon signature by the governor or, if not14 signed by the governor, upon expiration of the time for bills to become law without signature15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If16 vetoed by the governor and subsequently approved by the legislature, this Act shall become17 effective on the day following such approval.18 DIGEST The digest printed below was prepared by House Legislative Services.
