HOUSE BILL NO. 398

AN ACT1
To authorize and provide for entering into a cooperative endeavor agreement or the leasing2
of certain state property in Jefferson Parish; to provide for the property description;3
to provide for reservation of mineral rights; to provide terms and conditions; to4
provide for letting a contract by a request for proposals by the city of Kenner; to5
provide an effective date; and to provide for related matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1. The commissioner of administration, notwithstanding any other provision11
of law to the contrary, is hereby authorized and empowered to enter into a cooperative12
endeavor agreement or to lease any interest, excluding mineral rights, the state may have to13
all or any portion of the following described parcel of property to the responsible offerer14
whose proposal resulted in a contract award by the city of Kenner:15
Description of a 15.646 acre parcel of land located in the Parish of Jefferson,16
State of Louisiana in accordance with a plan entitled SURVEY SHOWING STATE17
LEASE AMENDMENT 5 FOR THE CITY OF KENNER, LOCATED IN LAKE18
PONTCHARTRAIN, JEFFERSON PARISH, LOUISIANA DATED JUNE 15,19
2012.20
Section 2. The commissioner of administration is hereby authorized to enter into21
such agreements, covenants, conditions, and stipulations and to execute such documents as22
necessary to properly effectuate any cooperative endeavor agreement or lease, excluding23
mineral rights, of the property described in Section 1 of this Act, and as more specifically24
described in any such agreements entered into and documents executed by and between the25
commissioner of administration and the responsible offerer whose proposal resulted in a26
contract award by the city of Kenner for an initial term of thirty years with four options to27 ENROLLEDHB NO. 398

renew, with each renewal being for a period of ten years, in exchange of consideration not1
less than seven and one-half percent of the appraised value of the property to be paid2
biannually to the state. In making an award to the responsible offerer, the city of Kenner3
shall follow the applicable procedures for letting a contract by a request for proposals4
provided in R.S. 39:1593(C)(2).  An award shall be made to the responsible offerer whose5
proposal is determined in writing by the city of Kenner to be the most advantageous to the6
state, taking into consideration review of price and the evaluation factors set forth in the7
request for proposals. The city of Kenner shall consult with the office of state purchasing8
in the division of administration in conducting the request for proposals and shall include9
the office of state purchasing in the review of the request for proposal and attendance at10
sessions of the evaluation committee.  No award shall be made to the responsible offerer11
unless the East Jefferson Levee District certifies to the city of Kenner that the proposal does12
not create a negative impact on hurricane and flood protection for the parish of Jefferson.13
Section 3. This Act shall become effective upon signature by the governor or, if not14
signed by the governor, upon expiration of the time for bills to become law without signature15
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If16
vetoed by the governor and subsequently approved by the legislature, this Act shall become17
effective on the day following such approval.18
