Regular Session, 2014 HOUSE BILL NO. 531 BY REPRESENTATIVE SEABAUGH ATTORNEY GENERAL: Requires the attorney general to represent the interests of the state in certain actions AN ACT1 To amend and reenact R.S. 49:257(C), relative to legal representation of the state; to provide2 for representation of the state by the attorney general in proceedings challenging the3 constitutionality of state statutes; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 49:257(C) is hereby amended and reenacted to read as follows: 6 ยง257. Legal representation of certain state agencies7 * * *8 C. Present law requires the attorney general to represent or supervise the representation of the interests of the state in actions challenging the constitutionality of a state statute or resolution of the legislature, at his discretion. Proposed law clarifies present law by providing that the attorney general is required to represent the state in actions challenging the constitutionality of a state statute or resolution of the legislature, but he has discretion in whether to represent or supervise the representation of the state.
