Abstract: Requires the attorney general to either represent or supervise the representation of the
interests of the state in actions challenging the constitutionality of a state statute or
resolution of the legislature.
Present law requires the attorney general to represent or supervise the representation of the
interests of the state in actions challenging the constitutionality of a state statute or resolution of
the legislature, at his discretion.
Proposed law clarifies present law by providing that the attorney general is required to represent
the state in actions challenging the constitutionality of a state statute or resolution of the
legislature, but he has discretion in whether to represent or supervise the representation of the
state.
