AN ACT1
To enact R.S. 33:3815.5, relative to the parishes of Grant and Rapides; to provide relative2
to Waterworks District No. 3 of Rapides Parish; to provide relative to water services3
supplied by the district to the residents of the parishes of Grant and Rapides; to4
authorize the district to acquire a privately owned water system located in Grant5
Parish for the purpose of supplying such services; to prohibit the district from6
acquiring any such system until the governing authorities of the district and Grant7
Parish enter into an inter-governmental agreement relative to the maintenance and8
operation of the system and the supply of water services; and to provide for related9
matters.10
Notice of intention to introduce this Act has been published11
as provided by Article III, Section 13 of the Constitution of12
Louisiana.13
Be it enacted by the Legislature of Louisiana:14
Section 1. R.S. 33:3815.5 is hereby enacted to read as follows:15
ยง3815.5. Waterworks District No. 3 of Rapides Parish; authority to acquire privately16
owned system in Grant Parish17
A. Notwithstanding any other provision of law to the contrary, Waterworks18
District No. 3 of Rapides Parish may acquire, by donation, one privately owned19
water system located in Grant Parish for the purpose of supplying water services to20
the residents of the parishes of Grant and Rapides. The district may acquire all21
property or facilities owned by any such system and may acquire all machinery22
deemed necessary by the district to maintain and operate the system. The district23
shall own in full ownership all property or facilities acquired pursuant to the24
provisions of this Subsection, and all such property or facilities shall be considered25

B. The district shall not acquire any water system pursuant to the provisions1
of Subsection A of this Section until the governing authorities of the district and the2
parish of Grant enter into an inter-governmental agreement that provides for the3
operation and maintenance of the system, including any expansion of the system's4
water lines, and requires the district to provide water services to the residents of the5
parish of Grant.6
C. The provisions of this Section shall not be construed as to void the7
provisions of any inter-governmental agreement between the parishes of Grant and8
Rapides in effect prior to the effective date of this Section, and the district may9
continue to supply water services to the residents of the parishes of Grant and10
Rapides pursuant to any inter-governmental agreement between the district and the11
parishes of Grant and Rapides in effect prior to the effective date of this Section for12
as long as the agreement remains in effect.13
