TRANSPORTATION:  Prohibits the issuance of moving violations to alleged violators
through mail
AN ACT1
To enact R.S. 32:398.1(D), relative to the issuance of traffic citations; to prohibit the2
issuance of moving violations through the mail; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 32:398.1(D) is hereby enacted to read as follows:5

D. It shall be unlawful for any municipal, parish or state traffic enforcement8
agency, official or employee thereof, or any officer to issue a moving violation to an9
alleged violator through the United States postal service. Citations issued for10
moving violations shall be delivered by domiciliary or personal service, pursuant to11
Article 735 of the Code of Criminal Procedure.12

Present law provides that traffic citations be issued through books with citations in

Proposed law prohibits traffic citations for moving violations from being issued to alleged
violators through the mail.  Requires that any such citation be delivered by domiciliary or
personal service, pursuant to CCRP Art. 735.
