CRIMINAL/APPEALS:  Limits appeals of death row inmates
AN ACT1
To repeal Code of Criminal Procedure Article 930.8(A)(4) providing for an exception to the2
time delays for filing an application for post-conviction relief for persons sentenced3
to death.4
Be it enacted by the Legislature of Louisiana:5
Section 1. Code of Criminal Procedure Article 930.8(A)(4) is hereby repealed in its6
entirety.7

Abstract: Repeals exception to the time period to file post-conviction relief petitions for
persons who are sentenced to death.
Present law provides procedures for post-conviction relief.
Present law provides that no application for post-conviction relief, including applications
which seek an out-of-time appeal, shall be considered if it is filed more than two years after
the judgment of conviction and sentence has become final unless the person asserting the
claim has been sentenced to death.
Proposed law repeals present law.
