Regular Session, 2014 HOUSE BILL NO. 765 BY REPRESENTATIVE PIERRE EMPLOYMENT: Provides relative to membership of Workers' Compensation Advisory Council AN ACT1 To amend and reenact R.S. 23:1294(A)(2)(introductory paragraph) and (g), and to enact R.S.2 23:1294(A)(4), relative to the Workers' Compensation Advisory Council; to provide3 with respect to membership; to provide for diverse representation within the state;4 and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 23:1294(A)(2)(introductory paragraph) and (g) are hereby amended7 and reenacted and R.S. 23:1294(A)(4) is hereby enacted to read as follows:8 ยง1294. Workers' Compensation Advisory Council9 A.10 * * *11 (2) It shall consist of seventeen members who are domiciled in Louisiana12 and appointed by the governor to serve at the pleasure of the governor. To the extent13 practicable, every organization or entity that provides nominations to the council14 shall strive for diversity in its appointments on the basis of sex, race, ethnicity, and15 geography. Present law creates the Workers' Compensation Advisory Council, which is made up of 17 members appointed by the governor and who serve at the pleasure of the governor. Proposed law provides that to the extent practicable, the nominating organization or entity shall strive for diversity in its appointments to the council, taking into consideration sex, race, ethnicity, and geography. Present law provides that each appointment must be approved by the Senate. Present law specifies from which industries and associations the members shall be chosen. Present law requires that the council meet and make recommendations to the governor and legislature on the implementation of workers' compensation laws. Proposed law retains present law. Proposed law requires that the members of the council be domiciled in La. Proposed law requires that each of the five members of the general public be from a different Public Service Commission district. Proposed law provides that the changes in the makeup of the council shall occur by attrition, with the governor appointing new members as required in proposed law.
