Regular Session, 2014 HOUSE BILL NO. 794 BY REPRESENTATIVES ROBIDEAUX AND BARRAS POLICE/MUNICIPAL: Provides relative to the salaries of employees of the police department for the city of Lafayette AN ACT1 To enact R.S. 33:2212(I), relative to the city of Lafayette; to provide relative to the city's2 police department; to provide relative to the salaries of the employees of the3 department; to provide relative to salary increases for such employees; to require that4 the employees receive an increase if the city collects a certain amount of sales tax5 revenues; to provide limitations; and to provide for related matters.6 Notice of intention to introduce this Act has been published7 as provided by Article III, Section 13 of the Constitution of8 Louisiana.9 Be it enacted by the Legislature of Louisiana:10 Section 1. R.S. 33:2212(I) is hereby enacted to read as follows:11 ยง2212. Minimum salaries; increases12 * * *13 I.(1) Notwithstanding any other provision of law to the contrary, each14 employee of the police department of the city of Lafayette shall receive an increase15 in salary of two percent after every fiscal year in which the sales tax revenues16 collected by the city of Lafayette exceed, by greater than three percent, the sales tax17 revenues collected by the city during the preceding fiscal year.18 (2) No employee of the police department shall receive an increase in salary19 pursuant to the provisions of Paragraph (1) of this Subsection after any fiscal year20 HLS 14RS-1481 ORIGINAL HB NO. 794 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. in which the sales tax revenues collected by the city do not exceed, by greater than1 three percent, the sales tax revenues collected by the city during the preceding fiscal2 year.3 (3)(a) The provisions of this Subsection shall not be construed as prohibiting4 any employee of the police department of the city from receiving an increase in5 salary pursuant to authority granted by any other applicable state or local law, rule,6 or regulation.7 (b) The provisions of the Subsection shall not be construed as requiring the8 city to expend any sales tax revenues that secure bonds that have been authorized9 or issued or revenues that have been dedicated to another purpose by other applicable10 state or local law or by proposition approved by electors voting in an election held11 for such purpose.12 Section 2. This Act shall become effective on July 1, 2014; if vetoed by the governor13 and subsequently approved by the legislature, this Act shall become effective on July 1,14 2014, or on the day following such approval by the legislature, whichever is later.15 DIGEST The digest printed below was prepared by House Legislative Services. Present law provides that except as otherwise provided by law, the governing body of each municipality having a population of not less than 12,000 nor more than 250,000 persons shall pay each employee of its police department a salary of not less than the minimum rate of pay established in accordance with the grades, ranks, or classes of positions as provided in present law. Present law provides that the minimum monthly salary to be paid any full-time employee of a police department is $300, and for officers of the grades listed below minimums are as follows: (1)Each employee of the police department employed in the position, grade, or class of sergeant, not less than $330 per month. (2)Each employee of the police department employed in the position, grade, or class of lieutenant, not less than $345 per month. (3)Each employee of the police department employed in the position, grade, or class of captain, not less than $375 per month. (4)Each employee of the police department employed in the position, grade, or class of major, not less than $405 per month. (5)Each employee of the police department employed in the position, grade, or class of assistant chief of police, not less than $420 per month. Proposed law retains present law. Present law requires that members of the police departments located in specified municipalities (Bossier City, Lake Charles, Jennings, Monroe, and Sulphur) who have had three years of continuous service (from a specified date) receive an increase in salary of 2% and thereafter to receive an increase in salary of 2% for each year of service. Present law is also applicable to the city of Abbeville, but there is no continuous service requirement. Provides for limitations. Proposed law retains present law and additionally requires that each employee of the police department of the city of Lafayette receives a salary increase of 2% after every fiscal year the sales tax revenues collected by the city of Lafayette exceed, by greater than 3%, the sales tax revenues collected by the city during the preceding fiscal year. Prohibits the granting of an increase pursuant to proposed law after a fiscal year in which the sales tax revenues did not exceed, by greater than 3%, the revenues collected during the preceding fiscal year. Proposed law provides that proposed law shall not be construed as prohibiting the employees from receiving a salary increase pursuant to authority granted by any other applicable law. Additionally provides that proposed law shall not be construed as requiring the city to expend any sales tax revenues that secure bonds that have been authorized or issued or have been dedicated to another purpose by other law or voter approval.
