MOTOR VEHICLES: Prohibits drivers from using hand-held cell phones while driving
AN ACT1
To amend and reenact R.S. 32:300.6(A)(1)(a) and to repeal R.S. 32:289.1, relative to cellular2
telephone use by drivers; to prohibit the use of wireless telecommunications devices3
by all Class "E" drivers; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 32:300.6(A)(1)(a) is hereby amended and reenacted to read as6
follows:7
ยง300.6. Use of wireless telecommunications devices by certain drivers prohibited;8
exceptions9
A.(1)(a) Except in a driver emergency and as provided in Subsection B of10
this Section, no person who holds a Class "E" learner's license or intermediate11
driver's license shall operate a motor vehicle on any public road or highway of this12
state while using any wireless telecommunications device to engage in a call, unless13
the wireless telecommunications device is a hands-free wireless telephone.14

Abstract: Prohibits use of cell phones by all Class "E" drivers.
Present law prohibits a person who holds a Class "E" learner's license or intermediate license
from using wireless communications devices while driving.
Proposed law modifies present law by prohibiting such use by all Class "E" drivers.
Present law prohibits a person during the first year that person holds his first driver's license
from Louisiana from using wireless communications devices while driving.
Proposed law repeals this provision.
