Regular Session, 2014 HOUSE BILL NO. 810 BY REPRESENTATIVE HARRISON COASTAL RESOURCES: Provides for freshwater diversions effects on fisheries AN ACT1 To enact R.S. 49:214.6.2(C)(5), relative to freshwater diversion projects; to provide for2 operation of freshwater diversion projects; to require notice of changes of operational3 plans; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. 49:214.6.2(C)(5) is hereby enacted to read as follows:6 ยง214.6.2. Functions and responsibilities; coastal activities7 * * *8 C. The authority shall:9 * * *10 (5) Operate any freshwater diversion constructed, operated, or maintained11 pursuant to this Part at a flow rate so as not to negatively affect the commercial and12 recreational fisheries through changes in salinity or nutrient levels. Thirty days prior13 to implementation of any change to an operational plan for a freshwater diversion14 project, a notice containing a summary of the change shall be submitted for15 publication to the Louisiana Register, the official journal of the parish in which the16 project is located, and the parishes affected by the outflow of the diversions. Present law authorizes the Coastal Protection and Restoration Authority to implement projects relative to the protection, conservation, enhancement, and restoration of the coastal areas of the state. Proposed law prohibits operating any freshwater diversion constructed, operated, or maintained pursuant to present law at a flow rate that negatively affects the commercial and recreational fisheries through changes in salinity or nutrient levels. Proposed law requires a notice containing a summary of any change to an operational plan be submitted to the La. Register, the official journal of the parish where the project is located, and the parishes affected 30 days prior to implementation. Proposed law provides that the summary shall indicate any change to the 5 parts per thousand salinity line impacted by the plan. (Adds R.S. 49:214.6.2(C)(5))
