HEALTH/DHH: Requires food service establishment inspection reports to be made
publicly available
AN ACT1
To amend and reenact R.S. 40:5.5(B), relative to the inspection of food service2
establishments; to require inspection reports to be posted on the Department of3
Health and Hospitals' Internet website within seven days of completion of the4
inspection; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 40:5.5(B) is hereby amended and reenacted to read as follows: 7
ยง5.5.  Sanitary inspections of certain restaurants; food safety certificates8

B.(1) No person, other than a representative of the restaurant, shall be10
notified by the department of the time and place of the inspection prior thereto and11
shall be nontransferable.12
(2) The Department of Health and Hospitals shall make all food service13
establishment inspection reports publicly available by posting a full and complete14
copy of each report on the department's Internet website no later than seven days15
after completion of the inspection.16

Present law provides for the sanitary inspection of food service establishments.
Proposed law retains present law and adds the requirement that the Dept. of Health and
Hospitals make all food service establishment inspection reports publicly available by
posting a full and complete copy of each report on the department's Internet website no later
than seven days after completion of the inspection.
