PUBLIC SERVICE COMN: Requires the Louisiana Public Service Commission to provide
annual notice to certain water systems
AN ACT1
To enact R.S. 45:1178, relative to rural water utility systems; to require the Louisiana Public2
Service Commission to provide written notice of the required submission of an3
annual report; to authorize the commission to collect an assessment when an annual4
report is filed after the deadline; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 45:1178 is hereby enacted to read as follows: 7
ยง1178.  Rural water utility systems; annual notice; assessment for late filing8
A. The commission shall provide each rural water utility system in this state,9
on an annual basis, with a written notice advising the rural water utility system of the10
requirement to file an annual report of the rural water utility system's financial and11
operating conditions with the commission.12
B. The notice shall be provided to each rural water utility system not less13
than sixty days prior to the deadline for the rural water utility system to file the14
annual report with the commission.15
C. If a rural water utility system files an annual report after the deadline to16
file, the commission may collect an assessment for late filing pursuant to the17
following:18
(1) If the annual report is filed ninety days or less after the deadline, an19

(2)  If the annual report is filed more than ninety days after the deadline, an1
assessment of five hundred dollars.2

Abstract: Requires the La. Public Service Commission to provide written notice to each
rural water utility system required to file an annual report detailing the system's
financial and operating conditions.
Present law provides for the creation of the La. Public Service Commission (LPSC) and
provides for the regulation of public utilities by the commission.
Proposed law retains present law and adds the requirement that the LPSC provide each rural
water utility system in this state, on an annual basis, with a written notice advising the rural
water utility system of the requirement to file an annual report of the rural water utility
system's financial and operating conditions with the commission.
Proposed law requires the notice to be provided to each rural water utility system not less
than 60 days prior to the deadline for the rural water utility system to file the annual report
with the LPSC.
Proposed law authorizes the LPSC, if a rural water utility system files an annual report after
the deadline to file, to collect an assessment for late filing pursuant to the following:
(1)If the annual report is filed 90 days or less after the deadline, an assessment of $50.
(2)If the annual report is filed more than 90 days after the deadline, an assessment of
$500.
