HOUSE BILL NO. 894
BY REPRESENTATIVE HOFFMANN
REAL ESTATE/APPRAISERS:  Provides relative to the membership requirements for the
Louisiana Real Estate Appraisers Board
AN ACT1
To amend and reenact R.S.37:3394(B) and (H), relative to the Louisiana Real Estate2
Appraisers Board; to provide for membership requirements and qualifications; and3
to provide for related matters.4
Be it enacted by the Legislature of Louisiana: 5
Section 1. R.S. 37:3394(B) and (H) are hereby amended and reenacted to read as6
follows:7

B.(1)  Nine The members shall be appointed by the governor with one10
member appointed from each congressional district and the remainder with four11
members appointed at large.  Of the nine members appointed by the governor:12
(a)  One Two shall be appointed from a list of three five names submitted by13
the Louisiana Bankers Association each of whom shall have been involved in real14
estate lending for at least five years.15
(b)  One shall be appointed from a list of three names submitted by the16
Community Bankers of Louisiana, each of whom shall have been involved in real17
estate lending for at least five years. One member shall have been engaged in the18
business of appraisal management for at least three years and shall be an employee19
or representative of a Louisiana licensed appraisal management company.20 HLS 14RS-1311	ENGROSSED

Additionally, this member shall be a citizen and qualified elector of Louisiana and1
licensed as a Louisiana certified real estate appraiser immediately preceding the2
appointment to the board.3
(c)  The remainder shall have been Louisiana residents engaged in the general4
practice of real estate appraising in the state of Louisiana for not less than five years5
immediately preceding their appointment.  The remainder shall have been domiciled6
in Louisiana and licensed as certified real estate appraisers for not less than five7
years immediately preceding the appointment.8
(2)  At least four of the nine members shall be general appraisers and at least9
two of the nine members shall be residential appraisers. All appraiser members shall10
be state certified.11

H.  Five Six members of the board shall constitute a quorum for all business.13

Section 2. This Act shall become effective upon signature of the by the governor or,15
if not signed by the governor, upon expiration of the time for bills to become law without16
signature by the governor, as provided by Article III, Section 18 of the Constitution of17
Louisiana. If vetoed by the governor and subsequently approved by the legislature, this Act18
shall become effective on the day following such approval.19

Abstract: Makes changes to the Louisiana Real Estate Appraisers Board membership.
Present law provides that there shall be nine members appointed to the Louisiana Real Estate
Appraisers Board (board) with one member appointed from each congressional district and
the remainder appointed at large.
Proposed law removes the reference to the number of members appointed to the board and

Present law provides that one member shall be appointed from a list of three names
submitted by the Louisiana Bankers Association each of whom shall have been involved in
real estate lending for at least five years.
Proposed law provides that two members, rather than one member, shall be appointed from
a list of five names, rather than three names, submitted by the Louisiana Bankers Association
each of whom shall have been involved in real estate lending for at least five years.
Present law provides that one member shall be appointed from a list of three names
submitted by the Community Bankers of Louisiana, each of whom shall have been involved
in real estate lending for at least five years.
Proposed law removes present law.
Proposed law adds a member to the board and provides that the additional member shall
have been engaged in the business of appraisal management for at least three years and shall
be an employee or representative of a Louisiana licensed appraisal management company.
This additional member shall also be a citizen and qualified electorate of Louisiana and
licensed as a Louisiana certified real estate appraiser immediately preceding the appointment
to the board.
Present law provides that the remainder of the board members shall have been Louisiana
residents engaged in the general practice of real estate appraising in Louisiana for not less
than five years immediately preceding their appointment. 
Proposed law removes present law and provides that the remainder of the board members
shall have been domiciled in Louisiana, rather than residents of Louisiana, and licensed as
certified real estate appraisers, rather than engaged in the general practice of real estate
appraising in Louisiana, for not less than five years immediately preceding the appointment.
Present law provides that at least four of the nine members shall be general appraisers and
at least two of the nine member shall be residential appraisers.
Proposed law retains present law requirements and removes reference to the total number
of members on the board.
Present law provides that five members of the board shall constitute a quorum for all
business.
Proposed law provides that six members of the board shall constitute a quorum for all
business.
Effective upon signature of governor or lapse of time for gubernatorial action.

Summary of Amendments Adopted by House
Committee Amendments Proposed by House Committee on Commerce to the original
bill.
1. Removed reference to total number of members on the Louisiana Real Estate
Appraisers Board (board).

elector of Louisiana certified real estate appraiser immediately preceding the
appointment to the board.
6. Provided that the remainder of the board members shall have been domiciled in
Louisiana, rather than residents of Louisiana, and licensed as certified real estate
appraisers, rather than engaged in the general practice of real estate appraising
in Louisiana, for not less than five years immediately preceding the appointment.
7. Provided that six members rather than five members shall constitute a quorum
for all business.
