Regular Session, 2014 HOUSE BILL NO. 900 BY REPRESENTATIVE HODGES AN ACT1 To enact R.S. 32:422.2, relative to driver education; to create the Louisiana Advisory2 Council on Driver Education; to provide for membership; to provide for the council's3 responsibilities; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:422.2 is hereby enacted to read as follows:6 ยง422.2. The Louisiana Advisory Council on Driver Education7 (1) The Louisiana Advisory Council on Driver Education, referred to in this8 Section as the "council", is hereby created to provide input and guidance to the9 Department of Public Safety and Corrections on matters pertaining to rules,10 regulations, and standards for licensure of defensive driving courses as provided in11 Chapter 29 of Part I of Title 55 of the Louisiana Administrative Code.12 (2) The council shall be composed of five voting members and two13 nonvoting ex officio members appointed by the commissioner of the office of motor14 vehicles. The membership shall consist of:15 (a) One current officer of the Driving School Association of Louisiana16 appointed from a list of three persons nominated by the president of the Driving17 School Association of Louisiana.18 (b) Two owners of licensed and approved commercial driving schools in19 Louisiana with current membership in the Driving School Association of Louisiana20 appointed from a list of four persons nominated by the president of the Driving21 School Association of Louisiana.22 ENROLLEDHB NO. 900 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (c) Two secondary education professionals from the Department of1 Education, who are driver's education instructors, appointed from a list of four2 persons nominated by the superintendent of the Department of Education.3 (d) One representative of the office of motor vehicles, licensing and4 certification division, appointed from a list of three persons nominated by the5 commissioner of the office of motor vehicles.6 (e) One representative of the Louisiana Highway Safety Commission7 appointed from a list of three persons nominated by the executive director of the8 Louisiana Highway Safety Commission.9 (3) Members listed in Subparagraphs (2)(a) through (c) of this Section shall10 be voting members. If a voting member is unable to attend a meeting, he may11 designate a person to serve as a proxy for voting purposes, if such act is executed in12 writing, signed by the member, and filed with the secretary at or before the meeting.13 (4) Members shall be appointed to serve an initial two-year term on the14 council and may be eligible to be reappointed to serve an additional two-year term.15 (5) A member shall be automatically removed from the advisory council if16 he has more than one unexcused absence during any twelve-month period. An17 absence is excused for purposes of this Paragraph when the cause is one which a18 reasonably prudent person would deem to take precedence over fulfillment of a19 solemn public duty or if the absence is known in advance by the member and he20 notifies the chairman of his absence not less than twenty-four hours in advance of the21 scheduled meeting. If a member designates a person to serve as a proxy as provided22 in Paragraph (3) of this Section, he shall still notify the chairman of his absence. 23 (6) A quorum shall consist of a simple majority of the active voting members24 or their proxies if the bylaws so provide.25 (7) Whenever a vacancy occurs in a council seat, whether by death,26 resignation, or automatic removal, such vacant seat shall no longer be counted as an27 active voting member in determining a quorum until a successor has been appointed28 by the commissioner of the office of motor vehicles in the same manner as the29 original appointment to fill the unexpired term.30 ENROLLEDHB NO. 900 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (8) Officers of the council shall include a chairman, vice chairman, and1 secretary.2 (9) All meetings shall be quarterly and conducted in accordance with the3 requirements of the state's Open Meetings Law. Procedural matters shall be4 conducted in accordance with the latest edition of Robert's Rules of Order. Meetings5 shall be held at the office of motor vehicles in Baton Rouge.6 (10) Members of the council shall serve without compensation and7 reimbursement of expenses other than compensation and reimbursement provided8 for by their employers.9 Section 2.
