Abstract: Creates a penalty for discharging cigarette butts from a vehicle.
Proposed law prohibits any person from disposing or allowing the disposal of a cigarette butt
from a vehicle upon any public place, any private property not owned by him, any rural property
not owned by him, or any waters of the state.
Proposed law provides that any person alleged to have violated proposed law shall be issued a
citation or summons or otherwise notified in writing that he must appear at a hearing at a time
and place to be specified in such citation or summons.
Proposed law provides that a person may still be found in violation of proposed law even if the
violation did not occur in front of a law enforcement officer, if the evidence presented in court
establishes the defendant committed the offense.
Proposed law requires that any person violating proposed law be fined $300 and be required to
perform 8 hours of community service.
Proposed law provides that each occurrence constitutes a separate violation.
