Regular Session, 2014 HOUSE BILL NO. 964 BY REPRESENTATIVE STUART BISHOP TRANSPORTATION DEPT: Provides for overhead power line information identified on Dept. of Transportation and Development public work projects AN ACT1 To enact R.S. 38:2223(A)(4), relative to Department of Transportation and Development2 public works projects and overhead power lines; to require the Department of3 Transportation and Development to provide certain information pertaining to4 overhead power lines on plans for certain public works project; to provide relative5 to liability for damages in the event that such information is not provided; and to6 provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 38:2223(A)(4) is hereby enacted to read as follows:9 ยง2223. Issuance of work orders and commencement of work; underground utilities;10 overhead power lines11 A.12 * * *13 (4) On the plans for any public works project let by the Department of14 Transportation and Development, the department or design professional of record15 shall locate and illustrate all overhead power lines and wattage thereof and identify16 the owner of each and all such lines. Proposed law requires DOTD or the design professional on the plans for any department public works project, to locate and illustrate all overhead power lines and indicate the wattage and identify the owner of each and all such lines. Proposed law provides that if the department or design professional of record fails to locate and illustrate all overhead power lines and indicate the wattage thereof and identify the owner of each and all such lines that contractor shall be released from any liability in connection with their damage unless such damage is caused by the negligence of the contractor. Proposed law requires the chief engineer of the department to direct that all projects that do not have a full topographic survey include information required by proposed law.
