HLS 14RS-4824 ORIGINAL Page 1 of 3 Regular Session, 2014 HOUSE CONCURRENT RESOLUTI ON NO. 168 BY REPRESENTATIVE LORUSSO SANITARY CODE: Creates a study committee to study and make recommendations with respect to the implementation of the Food Safety Modernization Act A CONCURRENT RESOLUTI ON1 To create a study committee to study and make recommendations with respect to the2 implementation of the FDA Food Safety Modernization Act.3 WHEREAS, approximately forty-eight million people, or one in six Americans, get4 sick, one hundred twenty-eight thousand are hospitalized, and three thousand die each year5 from foodborne diseases, according to recent data from the Centers for Disease Control and6 Prevention; and7 WHEREAS, this is a significant public health burden that is largely preventable; and8 WHEREAS, Louisiana has a world-renowned culture known for its unique cuisine9 and products and a deep commitment to safety and quality; and10 WHEREAS, the passage of the FDA Food Safety Modernization Act (FSMA)11 created historic changes in food safety law on a national scale by authorizing increased12 enforcement capability for the United States Food and Drug Administration (FDA), creating13 more accountability for farmers, and mandating enhanced partnerships between the FDA and14 state and local regulatory authorities; and15 WHEREAS, the FSMA builds a formal system of collaboration with other16 government agencies, both domestic and foreign, in recognition that all food safety agencies17 need to work together in an integrated way to achieve our public health goals.18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby19 create a study committee, composed of members as hereinafter provided, to study and make20 HLS 14RS-4824 ORIGINAL HCR NO. 168 Page 2 of 3 recommendations to the legislature with respect to the implementation of the FDA Food1 Safety Modernization Act.2 BE IT FURTHER RESOLVED that the study committee shall be composed of the3 following members:4 (1) The assistant secretary of the office of public health of the Department of Health5 and Hospitals or his designee. 6 (2) A representative from the sanitarian services division of the office of public7 health of the Department of Health and Hospitals.8 (3) The commissioner of agriculture or his designee.9 (4) The president of the Louisiana Restaurant Association or his designee.10 (5) The president of the Louisiana Association of Business and Industry or his11 designee.12 (6) The executive director of the Louisiana Retailers Association or his designee.13 (7) The president of the Louisiana Oil Marketers and Convenience Store Association14 or his designee.15 (8) The president of the Louisiana Public Health Association or his designee.16 (9) One member representing the Louisiana State University Agricultural Center.17 (10) One member representing the Southern University Agricultural Center.18 (11) One member of the House of Representatives appointed by the speaker of the19 House of Representatives.20 (12) One member of the Senate appointed by the president of the Senate.21 (13) One member appointed by the chairman of the House Committee on Health and22 Welfare.23 (14) One member appointed by the chairman of the Senate Committee on Health and24 Welfare.25 BE IT FURTHER RESOLVED that members of the study committee shall serve26 without compensation.27 BE IT FURTHER RESOLVED that the assistant secretary of the office of public28 health of the Department of Health and Hospitals or his designee shall serve as chair of the29 HLS 14RS-4824 ORIGINAL HCR NO. 168 Page 3 of 3 study committee and shall convene the first meeting of the committee no later than1 September 1, 2014.2 BE IT FURTHER RESOLVED that the secretary of the Department of Health and3 Hospitals shall designate staff of the department to assist the study committee in performing4 its duties.5 BE IT FURTHER RESOLVED that the study committee shall meet as necessary and6 shall report its findings to the legislature not later than January 30, 2015.7 DIGEST The digest printed below was prepared by House Legislative Services.
